I recently ordered a Howard Miller clock online from ClockWay-Gift Theory at clockway.com for $279.30.

Every page on the ClockWay website shows a banner at the top which says, among other things, "No Sales Tax *" and a banner at the bottom which says "We Pay Your Sales Tax Today *(read more) >." The same appears on each of the several screens provided for online purchases.

I naively placed reliance on the many occurrences of "No Sales Tax" and "We Pay Your Sales Tax" and did not "read more." When sales tax WAS charged on my order, I requested reversal but was denied and referred to the "read more" boilerplate which includes the following:

Okay, I was hooked; but I do believe that I was intentionally misled by banners that constitute deceptive claims. In good practice, asterisked footnotes are used to explain - not to contradict! For example: ALL OUR ITEMS ARE FIRST QUALITY* - and on a different page - (*except those that are not), would, I think, be considered by any reasonable person to be intentionally constructed to obfuscate if not deliberately deceive. Is: NO SALES TAX* - and on the last page - (*however, in CA and on Howard Miller and Ridgeway clocks, there is") so different? In actual ClockWay practice, "No Sales Tax" and "We Pay Your Sales Tax" prove to be false assertions.

I write this simply as a cautionary warning to online shoppers re this and other online vendors: Don't be misled by the banners; read the fine print to know what the deal really is.

Perhaps I should also note that in doing my research, I found other negative comments re clockway (see, for example, http://www.thethingsiwant.com/site/clockway.com/ ).

This company has THE WORST customer service. Do not shop here. Nicole in Cust. Service is absolutely inept and rude.....They will rip you off on shipping< dont be fooled.

I purchased an "atomic" outdoor clock in Oct. 2010...to make a long story short we followed all the directions for setting the clock including calling the number for help as recommendation. We live close to a tower-took several days for it to adjust as recommended. The clock would never adjust to correct time. Notified Clockway via e-mail... Got the return merchandise ok and completed the form from ClockWay-Gift theory &e-mailed it to them. Wrapped the clock in original packing, followed all packing directions carefully and personally took pkg to UPS.UPS said it would be insured for $100...guess I didn't understand I needed my own insurance?? Didn't hear back from Clockway that they had rec'd the clock. At end Of Dec. I called my credit card company and they credited my account with the amt of purchase ($65.00)after contacting Clockway-Gift Theory. the credit card company reminded me to keep all my paperwork in case of a rebuttal. On 21 January , credit card company notified me that Clockway-Gift Theory were denying the claim that the package was damaged. A note was made by UPS on the paperwork that the damage was reported AFTER pkg was delivered. Now the claim is with UPS.

I would recommend one not order anything from this company unless you are certain you would never have to return it. In my opinion, they are not honest. I bet that clock had been sold before and I would bet it was not physically damaged when it was returned.

I will NEVER deal with these people again. I had even immediately ordered another clock that was not "atomic" and it is working fine. Then I found out the clocks like I bought from them are now on sale in well known home improvement store.
