Pay more in shipping to return wrong order then 20% restocking fee

Paid $525 for 110cc atv with remote stop and received a 90cc with no remote stop and now they want me to pay hundreds in shipping to return it not to mention the 20% restocking fee. Owner Jeremy is impossible. After I filed a complaint on BBB.com he changed his website to say how they are so committed to 100% customer satisfaction, scared are we? Read the complaint and his response or the lack of on bbb.com

in an email to the bbb ,q9 powersports claims the engines are bored out at the factory to 125cc

to this date of 6/5/2010 no proof has been submitted,its not possible to bore out a 110cc block to 125cc also in a pic i sent you the engine is stamped 107cc when i went to sell the atv i can only sell it as a 107cc ,which means its a smaller atv,this is where the fruad claim comes in.

i sent you a copy of the internet ad that clearly states a 125cc model atv with a child safty tether,in another email to the bbb q9powersports denies he advertised that,but if you look at his internet ad,it says 125cc with child safty tether.

i would like to point out that q9powersports claims in there ads that this atv is for 12yo and up

the machine has a warning sticker that says 16 yo and up,my 12 year old pointed that out.

the atv also leaks gas from the carb,has a broken light,a dead battery.i pointed these things out so when he gets it back he understands im not liable for these damages

also please note on the redispute form from q9powersports to the credit card co. is dated may 12th 2010,and note that on may 13th 2010 he claims to send out a semi to pick up the atv

ia an email to the bbb dated may 14th 2010 he claims he is sending out a semi to pick up the atv and just that statement alone ,has the bbb claim case resolved.

so he is redisputeing the claim to the cc co.0n may12th and then the next day he tells me in an email he is going to pick up the atv and credit my acc 1000 dollars and the next day he tells the bbb he is picking up the atv,the trucking wont come because the truck is to large to fit in the driveway and they dont have smaller trucks,i dident cancel the truck,i offered my help to load the atv onto the the truck,

please note that i shouldent be responsible for anything i dident order that atv i ordered the 125cc with a safty tether cord,i got a 107 cc with out a safty tether cord. my son has bought another atv in the mean time.q9 powersports is committing fraud why is this company allowed to keep doing this type of bait and switch tatic,also please note as q9powersports told you he was charged for the failed pickup twice he is a liar the old domion trucking co did not charge him anything for no pick up the first time(no lift gate)and no charge for the second time cuz they never came out with a truck,they only charge when something is picked up.please ask me anything to clarify anything i have sent,also note under pains of perjury i filled a police report of fraud with madision pd case #6082453662

Called and agreed with customer to send a different model so they could get the color they wanted in a timely mannor. Yes, returns are suject to a 20% restocking fee and the customer must return the item to us. We are commited to customer Satifaction. We try our best:)
