Outrageous overdraft fees.

TDBanknorth 21st Avenue Paterson, Ne 07501 US In the past, I have done business with other banks, but I have never experienced anything like what this bank is doing. I know that if you overdraw your account, there is a $35. fee. This bank charges the fee every five days until you make a deposit. I've spoken to these cold hearted cut throats and have gotten nowhere with them. I'm a senior citizen, and if I'm not mistaken, it is against federal law to charge overdraft fees on direct deposit Social Security checks. It fell on deaf ears with these people. Since us seniors only get paid once a month, I think this is a rip off on a grand scale and should be stopped. We're talking anywhere between $100. and $200. for the month just in fees if you overdraw your account. I want every cent this bank stole from me in fees. This may be a scam they are doing to make some extra money by ripping off the consumers. Yes they are screwing me to. I thought I had my last truck payment done twice so far and they keep charging me. They charge me 18% interest every day. I do not even have enough time for my payment to get to them in the mail before its more then the check i send. so I can not get it payed off. I was told I owed this much over the phone . I get the bill and it shows Loan Balance of 224.98 . I was told by a rep from TD bank I had 20 days to pay it so i did. A week later they tell me I owe another 91$ and they are charging me 18% interest daily. It takes the mail 1 to 2 days to get there so I can not pay it off, i think they know it and use it to rack up more charges. I will not give them my debit card info. I went to the Better Business bureau of Florida filed a complaint and said i want the total amount owed posted there and given the 2 days to get the check there and when it arrives the post on the BBB complaint that it is paid in full. I have paid over $1,000 in overdraft fee's in 2010 alone. They have re-ordered highest to lowest debits, charged me more than the actual overdraft negatives and charged me an overdraft fee for the overdraft fee...go figure. I'm finally getting a lawyer because there are obvious instances of fraud pertaining to my account. Just the fact that they charge overdraft fee's for the overdraft charge is illegal. This is not the bank I used to know as Commerce Bank. This caused and over draft of something else which caused another which in turn caused some else to bounce and yet another fee. I got them to fix that because was ridiculous. Now last week I deserved probably 2 fees because a lapse in saving depositing into my account and two purchases going over. However instead of getting they gave me 5 over draft fees which they took late in the day. I deposited more money accuired another fee. Then because of that I deposited more money and accuired 3 more. I then deposited more money and about to be hit with 3 more fee. One of which is for their cycle charge. Bastards make sure they get their money. basicaly last week they have charged me 13 fees and drained my savings account from a different bank. I went to the local branch and they didn't try to help me and refused to see my attempts to fix the situation, instead they tried to seel me a savings account with a $250 minimum deposit. They are crooks. They should have a limit as to how much finanical damage they can cause a person, but Im so glad their CEO can probably purchase half of Aruba or some other elaborate place. I have already opened account with Bank of America and am in the process of moving all my stuff over. I have lodged a complaint with the BBB. I've had an account with them, for nearly two years now. Never, in all my years of banking, have I had the troubles with other banks, that I've had with TD Banknorth! They are unethical, greedy financial 'vampires', who are only out to rob their customers. Their fees are indeed outrageous, to say the least. And they do work their policies, to rip off their customers with all these fees that they charge. I would LOVE to be involved in a class action suit against TD Banknorth. Again, $400 in fees which would not happened if it wasn't for their system that is set up in such a way that you may have money in your account and still at the end of the day they will rearrange the purchases so you end up paying hundred of dollars. They just took half of my paycheck in overdraft fees, by re-arranging my statement so that the bigger charges came first, leaving me with $35 overdraft fees for every $2 purchase i made after that, gave me an attitude and hung up on me when i asked "What part of TD Bank IS convenient?" I then told them about how my daughter's 2nd birthday at CHUCK E CHEESE is coming up and i need my money back to be able to afford it, they just responded with "It's not our problem-- you have to keep track of your own account, it's not our job to do it for you" Well-- i WAS keeping track of my account-- i had plenty to cover all of those little $2 charges, but a huge UNAUTHORIZED charge which was refunded is what threw everything off. They say "That's not our problem" tho. I told them I was going to bank elsewhere if they didnt refund my money, they said "Well whatever you feel you have to do." This was a supervisor saying that too. They allow falsified charges from KNOWN scammers, (one without even the proper routing number on the fake check) charge overdrafts for these debits and make you go through hoops to reverse them, IF they reverse them. They allow you to CHARGE (debit visa) beyond your balance and hit you with $35 OVERDRAFT fees for charges under $10. Their "customer service" claims they do this to "save" you from the embarrassment of the card being declined. Really? So you are saving me from embarrassment by charging me $35 to make a $7 purchase. I work retail and deal with customers using debit every day, other banks simply come up as "Declined", no embarrassment, got to pay another way. TD does not give you the choice of alternate payment, they merely rape you for the privilege of not being embarrassed. Oh and they wont let you know you are overdrawn, but WILL continue letting you make debit purchases (and more overdrafts). Tne only reason I have not left is that I havent had the money left over after bills to open a new account elsewhere, with sufficient timing to switch my auto deposit/debits to the new bank. For instances, I incurred $210.00 in overdraft fees using my debit card. the funny thing was that the transactions did not stop when the account went negative. they allowed them to keep going so they could get their $35.00 per transaction fee from me. I called them to complain and they said I could "OPT OUT" and have my visa debit card stop before the account went negative. I told them I had never heard of this before and I should have been offered this when I opened the account. They did refund my fees for that incident. Now, 2 days later, I have another $70.00 in fees with no justification from the Customer Service Rep on the phone. I deposited a check in the amount of $100.43 that was drawn on TD Bank. I told the girl on the phone that this check was drawn on their bank and should have cleared immediately. Her excuse was I did not have enough in my account to cover it. It was drawn on their bank. They could go into the account it was drawn on and see that there was plenty of money in that persons account. And to top it off, according to their online banking, my account would not be negative had they not taken out their fees. So what is the reason for the damn fees. I argue with the Customer Service Rep. She puts me on hold and says she will see if she can refund me the $70.00. She comes back on the phone and tells me she cannot do it, but I can talk to her supervisor. The supervisor never answers the phone. I called TD banks customer service and found that transactions are not paid in the order that they are made. They are paid from the highest amount to the lowest amount. Therefore, if you have a balance of $99.00 and you make four transactions one for $10.00, the second for $5.00, the third for $15.00, and the forth for $100.00 they will pay the $100.00 transaction first. And there you have it. Now they are charging you four overdraft fees instead of just one. This is too obvious and they should not be allowed to get away with such a despicable practice. I have had a lot of theese overdraft fees as well. I went to the bank and they printed out a statment for me, from October 19th my account went negative exactly 2 times. In that time period I was hit 6 times with overdraft fees all ranging $35 to $175. this is absolutely horrible. I am the head of a single income family of 5 just trying to make ends meet and theese horrible, greedy people just keep pushing me under water. Don't know how much more I can take. You deliberately process payments in a way that will incur overdraft fees. You do not automatically cash paychecks which have been automatically cashed for 8 years with Commerce Bank and are secured by TD Bank. Your customer service is awful, on the phone and within each location. You famously and consistently are afflicted by computer glitches and employee incompetence, which leads to inconvenience and stress for your poor customers. I will tell everyone I know exactly how awful your bank is, and I will be closing my account as soon as all of my checks have cleared. Commerce Bank was so good, I cannot believe they sold out to these shiesters. Here's what TD bank does, even after correcting their system, and claiming all is well once again: (1) Let's say you use your debit card, and the charge is run as a credit card charge instead of a debit. They take three entire business days to post, when Commerce posted immediately or the next day. (2) Let's say you share a card with a family member, you live apart, and you do not communicate about who took what money out of the shared account. This is exactly the scenario TD bank hopes for, because they let the charges go through even on insufficient positive funds, they add the charges all together three days later, and charge you $35 for every overdraft. (3) Try this experiment: Try to use your card as a credit card when there is a negative balance. I did this several times, out of curiosity. It is impossible to overdraft when your card has a negative balance. yet it is possible to overdraft if you have a positive $1 balance. This means, from a software transaction perspective, they are checking for negative balances, but not checking for sufficient balances, when they easily could. THIS IS PREDATORY. Some fat executive thought this would be a great scam to rake in more fees, and supposedly "punish" the poor, or "irresponsible". THIS IS PREDATORY. BYE BYE JD POWER AWARD. They were a joy to deal with and had their banking policies clearly stated for the customer. In the past 2 months I have experienced nightmares with my bank account and the accrual of overdraft and insufficient funds fees. TD claims that with a small business checking account, all deposits made before 6:00 will be available the following bank day. What they failed to inform me of is that under their new policy, they only release 100 of the deposit for the following day and hold the remaining until they so choose to release it to the account. It gets better!! When I download my banking to my Quickbooks the following day, the available balance showed the entire deposit made the day before. Like usual I made my necessary purchases and bill payments going by what the online banking has informed me I have available in my account. The following day I downloaded my account info once again and discovered $175.00 in overdraft fees. I had to visit my branch and battle these fees. After getting an attitude and being told By Dorothy, the manager of the Manahawkin branch that this is "my fault and I should learn how to balance my books" I managed to get $70.00 of it refunded after being embarrassed in the middle of the bank's open air lobby. Since the occurrence I have accrued approximately 400-500 dollars more in fees spawning from my original overdraft that never gave me a chance to get back into the positive. The practices that TD has enacted in the past 2 months are unethical, deceptive and somewhat criminal. There is a pending class action lawsuit against TD for their unethical practices. I remember, over 10 years ago, a bank I worked with held the terms of the existing account - honoring those of the bank they bought out. The only way they would change is if we closed the account. My advice, for a persistent problem that they refuse to resolve with terms that are acceptable to you, is to contact the Better Business Bureau and provide them with as much detail as possible. I've resorted to this with Tech, Finance, and other companies and their ears perk up shortly thereafter. Good luck. This account had no fees, no minimum balances, no atm charges anywhere, etc...All of a sudden, earlier this year they changed all of that, and now they charged me a $15 fee for below the minimum balance and they debited that from my overdraft protection. Is it just me or should they have honored the free checking accts for exising customers and shut them down for new ones?? I think it is crazy that banks can just change the rules on you with no say just to make money on charging clients fees!!!! Stay away from this bank, I will never bank with them again. It should not be legal to charge $35 on a $3.50 charge. I am closing my account with bank north and going to a credit union. Our last straw was just today when we were charged $105.00 for overdrafts because of this new policy of charging for pending transactions! We also never saw anything about this policy changing. And WHY if ONE transaction makes you overdraft are they charging for EVERYTHING in the pending????? This is just SO WRONG! I had a transaction that appeared as pending on April 29th, didn't actually post to my account until May 1st. Also, on April 30th my paycheck was direct deposited to my account, so there was never a negative balance. Yet that didn't stop Banknorth from charging me a $30 overdraft fee on April 30th! When I contacted their customer service department to complain, they said an "insert" was sent out in January. However, after an exhaustive search, I was unable to find any information about this new policy on their website. This is yet another way for the greedy banks to rip off decent, hardworking people!
