Copy of complaint taken by the BBB of Chicago and Northern Illinois (Address and Account number X'ed out for my protection)

Consumer's Original Complaint :

My account With Nationwide was opened on 04/24/2006 account #XXXXXX, for a 2002 Ford Taurus and was paid off early on 10/15/2007. In mid January, that I had not received my title from Nationwide. I contacted Nationwide and spoke with a female who was very helpful and stated that the title and a refund check was sent out shortly after the account was paid off. I inquired where the title and check were sent to, and she stated that the address on file was "P.O. Box XXXX, Aurora, Illinois". When I disputed the address change, she placed me in contact with her manager, Mr. Raymond Flores. After explaining the story to him, he advised that he would need to pull the DVD from the phone call that was recorded for the address change. Mr. Flores was very pleasant and said that he would call me back within a couple days.

During this time, I met with a Postal Official at the main Aurora Post Office at 525 North Broadway, where the post office boxes are located. They advised that there was no mail being held as undeliverable with my name or for their PO Box XXXX.

I called Mr. Flores back around the first of February after not hearing from him. Mr. Flores said that there were other requests for the same DVD and that he would contact me within "72 hours". I made sure with Mr. Flores that he had my contact information.

I called Mr. Flores back on February 8th at 5:15pm, after again, not hearing from him. Mr. Flores said that he did not have an answer for me yet, but would contact me on February 11th. I again made sure that Mr. Flores had my contact information.

I once again contacted Mr. Flores on February 21st, after again, not hearing anything. After being transferred from person to person and asking for Mr. Flores, I spoke with a gentleman who stated he was "on the phone, but should be wrapping up if I wanted to hold" to which I replied yes. The gentleman asked for my name and what the nature of the call was. I gave him my name and explained it was reference a missing title. I was placed on hold and after a minute or so, I heard someone pick up, and in the background could hear the same gentleman state "I have a Chris XXXXXX on the phone.....it sounds like he knows you....about a title". At this point I heard another gentleman in the background whisper "hang up", and the phone line went dead.

I wrote the Vice President, Mr. Art Delacruz a letter on February 21st asking for assistance in reticfying the situation.

On March 18th, I contacted Mr. Delacruz after not hearing anything. Mr. Delacruz seemed to be bothered with my request and stated he never got my letter that he has "people to read his mail and I would have never been given a letter of such trivial nature". Mr. Delacruz did look over my account and stated that his company was not in a position to reissue a refund check or would not take steps to place the title that they had lost.

At this point no one can answer my questions of :

1) Has the refund check been chased? Nationwide has put a stop payment on the check but cannot tell me if it has been cashed and will not issue me another refund check which is owed to me.

2) Who authorized a change of address to the wrong address?

Nationwide to date has refused to issue a replacement refund check which is owed to be back in October 2007 nor have they issued a replacement title.

Consumer's Desired Resolution:

Refund check which is owedReplacement title issued to me at Nationwides cost
