Pitney Bowes falsifies contracts

Postage Meter Pitney Bowes 2225 American Dr. Neenah, WI 54956 Neenah, WI 54956 US To Whom It May Concern: Pitney Bowes Executive Chairman, Michael Critelli stated: âOur history is one steeped in a commitment to values and principles that are fundamental to our belief that when we do the right thing, we will always win. We are proud of our track record of creating, raising, and exceeding industry norms in the areas of business practices, corporate governance, diversity, and community relations.â However, our experience with Pitney Bowes has proven to be anything but good fundamental values. Back in September 2006 I received a call from a Pitney Bowes representative, Laurie Bendolph, who stated that our current postage meter must be exchanged for a newer model. She stated that people had learned how to make fraudulent charges on our existing model. She said a representative would be coming to exchange it. An older gentleman named Elton came and swapped out our postage machine. He explained how to use it and was very friendly. Like a UPS person asks, he asked one of my new employees, Katie Holland, to sign stating we received the new machine. There was no mention of a contract. I continued to pay my quarterly statement assuming our original contract from 1999 had ended and I was just paying as we go while we were still using the machine. In December 2007 we no longer needed our machine. I had Katie call to cancel our service with Pitney Bowes. She was informed by the representative that we were under a 105 month contract. The representative stated that she had signed a new contract back in September of 2006. She explained to the representative that she only signed stating that we had received our new machine and that she would never sign a contract. Nor does she have the authority to sign a contract. She asked them to send us an original copy of the lease. To this day we have not received one. The only thing we have received was a copy of the 2006 lease that had been copied and pasted (enclosure 6). The word âManagerâ had been copied from the 1999 contract and put on that one. Katie was not a manager. Also, other information had been falsified. Pitney Bowes has also not been able to locate a copy of our 1999 contract. They keep sending us a copy of a lease for Methodist Home for the Children (enclosure 5). We are not, and have never been, associated with them. Since December 2007 we have been corresponding with Pitney Bowes to get this resolved. We have only been given the run-around and numerous employees have been very rude. Laurie Bendolph, even stated that she remembered when our machine had to be exchanged and that no contract should have been signed at that time. However, she said she could not help since so much time had gone by. I explained that I was under the impression that I was just paying as I go. She then put me in contact with her manager, Mark Nikola. Laurie and Mark have been the only two polite people Katie has talked to at the company. Mark has been going to different departments to look for the original contract, but to this date has been unable to locate it. We have also sent four certified letters and have not received a response back. Below is a copy of our correspondence log with Pitney Bowes:
12/27/07 â Called Pitney Bowes to cancel our service. Transferred to 5 people, told them we were no longer using our machine, wanted to return it. I was told we were under contract, advised them that the signature on the contract was not valid and that we were forced to change postage meters b/c other companies were committing fraud on the old model machine, I was told it was not renewing our contract. Asked for copy of lease agreement to be sent. 1/2/08 â did not receive lease contract. Called again, said they would email. 1/2/07- only cover letter was emailed, contract not attached, said would re-email and also mail. 1/3/07 â received email copy of lease for Methodist Home for Children, not us, called again, said would re-email. 1/4/07 â Received copy of 2006 lease, not original, it was cut and pasted. I signed in Sept. 06, only that I received the new postage meter, not a contract. They said since Dr. Kean has been paying the bill that we were stuck to the contract, by paying, we are agreeing to the lease. Explained that he thought we were out of contract, and like a cell phone, were just paying monthly while we were using the machine. Told I would get a call back, no call back. We stopped paying our quarterly statement to further let Pitney Bowes know that we no longer required their services. 1/9/07 â Called again, trnsfrd numerous times, asked to spk w/ manager. Talk to sales rep, Eltonâs, manager Laurie S. Bendoff (800-203-2581 x6533). She agreed that we were required to have our model exchanged out, and that the sales rep should not have had anyone sign anything, and our lease should not have been renewed. She apologized, and said since itâs been so long itâs out of her hands. She connected me w/ her manager Mark Nikola (x7304) who told me that my only option was to write a letter to the termination dept. He emailed me the info. Wrote letter to termination dept. (enclosure 1), told it would take a few weeks to get a response. 1/20/08 â Called to check status of letter, said it was received and that we would receive a reply on 2/14. Asked why we could not receive a reply earlier, said they would send an email to that dept. asking them to send reply earlier. 2/14/08 â received settlement letter, called Laurie B. back and asked her to help me out since she knew we should not have had our contract renewed. Said she would tell her manager Mark to call back. No call back. 2/18/08 â spk w/ laurie again, said she would tell mark to call back. 2/19/08 â no call back, left msg. 2/20/08 â no call back , left msg. 2/21/08 â spk w/ laurie, apologized for Mark not calling back, said she was walking down to talk w/ his mananger Dan Sileo, who would call me back today. 2/21/08 â Dan Selio called, was rude, said that there is absolutely nothing that can be done, they are very firm on their contract, we either pay the settlement offer, keep paying our monthly payments, or go to collections. He said I needed to talk to the Resolution Dept @ 800-732-7222. Mailed 2nd letter (enclosure 2). 2/22/08 â Called and spk w/ Carrie. She basically said the same, we pay or go to collections. I told her that we were going to get an attorney and needed the contact info. She gave me atty contact info and said that they would tell the atty the exact same thingâ¦pay or go to collections, they do not settle. 2/27/08 â Dr. Kean called Pitney Bowes, staff was extremely rude. The representative would not let him speak to a manager. He was just transferred around and never got someone who would or could help. He talked to an atty. to get this resolved. Sent all info to atty. 2/27/08 â Did not have copy of original lease ( I believe signed in 99 by Gia Kean). Called leasing dept to get a copy. Unable to pull up copy. Itâs showing up as Methodist Home for the Children, they have sent us that one numerous times. I have explained that is the wrong one. April in Leasing said that they did not have a copy of our original lease, try calling Mitch Hamlett in sales (919-872-1954). Mitch is out of the office until 3/12. Trnsfrd to Judy, not available. Tried calling Laurie Bendoff again, left msg. Asking her to email me our original contract ASAP. No response, called again, she said she would go to the dept. that handles that and get the contract and email it to me. Never received 2/27/08 â Atty advised us to send 3rd letter (enclosure 3) stating that we do not have a binding contract and that as of 3/12/08 we will start charging them $25/day occupancy tax. 2/29/08 â Lft msg for laurie, no response. Called her manager Nick, told him I needed it in the next hour b/c I was going out of town for a week and the atty needed all the info b4 I left. He said he would call back in 10 min. 50min later, called him, said he was still searching, would call back in a few minutes. Mark called back, unable to locate, said would walk right down to another dept to get it. 3/6/08 â Called Mark back, said he still could not find the original lease. He asked me to give him until Wed. 3/12 to locate it. 3/11/08 â Mailed another certified letter asking for original contract (enclosure 4). 3/12/08 - Left 2 messages for Mark. No response. As you can see from the above phone log, we have been trying to resolve this issue with Pitney Bowes for quite a while. Due to the fact that I have never had a valid signed contract since 1999, which has since expired, we are not under contract with you. As we stated in our third letter that we sent you, as of March 12, 2008 we have started charging $25 per day occupancy rent since nobody has come to pick up the equipment. I expect to resolve this issue in a timely manner. Please call me at 252-321-3579 so we may do so. Sincerely, Brian M.
