Improper Charges for Carpet Replacement

Tenant was living at Playa Marina Apartments for about 4 years. Carpet was in good condition upon leaving the property.


Aside from the customary cleaning charges, Decron Management deducted carpet replacement from the security deposit, regardless of the condition of the carpet. California law states "Normal wear and tear to carpets, drapes and other furnishings cannot be charged against a tenant's security deposit.223 Normal wear and tear includes simple wearing down of carpet and drapes because of normal use or aging, and includes moderate dirt or spotting. In contrast, large rips or indelible stains justify a deduction from the tenant's security deposit for repairing the carpet or drapes, or replacing them if that is reasonably necessary".


Tenant has photos to prove carpet was in good condition, aside from normal wear and tear due to years of stay on the said unit. Decron Management refuses to pay back tenant from the security deposit deduction.

To add to this comment. I lived at The Joshua owned and managed by Decron Properties and experienced the same thing. On top of bad management and horrible interior walls for building noise. This is really a dishonest ruthless company. I highly recommend not doing business with them.
