Lanscaper refuses to return deposit

I was initially impressed with Eric's professionalism and good vision of what we wanted, and the price quote was right in the middle of the other estimates. But we are currently engaged in a drawn out disagreement about the return of my deposit check.

He failed to start the job within a reasonable amount of time from when he said he would. There were several excuses offered, legitimate or otherwise, I am not sure.

In mid May '08 he verbally agreed to return my deposit. He has since claimed that he had sent me a check that dissappeared and then a certified check, sent registered mail, which he claims I signed for and cashed.

I am still trying to resolve this issue with him. I will reserve final judgment pending the outcome of our discussions, but at this point I would advise caution if interested in starting up a new project with him.
