capital one credit cards

i called on may 31 and had a fee of over the limit fee on and account i had just paid off applied for over the limit ,which after argueing the fact that the account was paid off 2 days before they applied the charge of 39.00 (which was due on june 02) which they agreed they would wave with the 39.00 doller late fee because it took them 2 days to apply the previous payment to the account. then this month i get a bill with another late fee(15.00) and member fee (5.00) on top of 31.25 for the over limit fee(which was waved).

now how could i be over the limit if the fee is 39.00 and my balance with fee is 31.25(with the finance charge)let alone the account was paid off before the previous bill was sent.

the part that gets me is now i have on my credit report 2 months late on a paid off and closed credit cards
