. The car was purchased with no warranty. I picked the car up on 5/27/08. I drove it just over 100 miles when it broke down in Harrington, DE. I called Joe at Diamond Auto / Car Auto Connection / paulnikk (eBay seller) of Bristol, PA

. I said that I understood that I had purchased the vehicle with no warranty, but I certainly expected to at least make it home. He said that he would help me out and that he could not believe that it happened. The vehicle was towed to IG Burton Chev in Seaford, DE. at the cost of $125.00. Joe was in contact with myself and IG Burton until the car was fixed. Turns out that the heads were warped and needed to be reworked. The total bill was for $2640.11. I also had the brake rotors turned while it was there, for they were bad. Joe agreed to pay half. After talking with IG Burton, he decided that his half would be $1100.00. On 6/8 he said that he would mail me a check for $1100.00. On about 6/23 he sent a check for $400.00, but told me that he had stopped payment on it since I had opened a complaint with eBay and Paypal. You only have 30 days to file and I had no choice. He then told me on 6/26 to cash the check. He told me that the rest was coming. He had told me before that he would send 2 checks for "bookkeeping purposes". He stopped taking my calls and now will not answer emails.

I have been more than patient and I realize that there was no warranty with this vehicle. But he did agree to help me out. And that is what I can't understand. $1100.00 is a small part of the money that I am out on this deal. I can't get any help from eBay because he went outside of eBay.

Over the years I have bought two vehicles from "Joe" at Diamond Auto; both were excellent and served me well. I still drive the last one and so far I have driven it 80,000 miles since purchase. I had one minor problem with the car initially after purchase and Joe was right there for a total and complete repair with NO COST to me. I think this is an honest man who has been pushed into a corner by this one person. I would (and have) taken family and friends to this dealership with no fear of a bad deal. Sorry for this one guy but maybe a little trust would have gone some distance rather than right off the cuff burning him to eBay and PayPal.

Sadly when you cashed his check you sealed the deal..once you cash a check you accept the payment, (you should have returned it to him and said you wanted it all not a partial payment..) therefore by law he owes you nothing else...he knew this and set you up..you can attempt small claims court..make copies of his emails and maybe the judge will feel sorry for you and make him pay based on his promise to pay the full amount of what he owed you from the start, maybe the Judge will see that he aimed to defraud you from the start, but somehow I feel you are out that money..if you do sue ask for court fees in the judgement..Good Luck!
