I saw this builder advertising on tv how he looks at the work ethics, =

salary and not just the credit

score. I called, filled out an application. He called, the builder, and =

said I was approved. I went to see him and told him I only had $5000.00 =

for closing and if that was not enough then we would not go any further. =

He said, that would do and that he got me a loan by tagging by lower =

score of 573 in with those and they would take it.

So, I pick out the lot, etc. On my second visit, I asked about the =

failing mortgage compaines and he said don't worry, I got you a =

government loan.

Okay, that's not what he said the first time. I picked out the lot, =

brick. Then a few weeks later, he called me and told me not to say =

anything but

that he might be able to get me a different loan at 6% instead of the =

9%. I said okay, great. Things continue on the house. The house was to =

be ready by Thanksgiving, but it wasn't. Then he has one of his =

employees call me to come up and sign something. When I got there, he =

said you did not pay $500.00. I said Peter said I did not have to pay =

anything down, that was the going thing at the time I came into the =

picture, but now he was asking $500.00 down. I said, I was only suppose =

$5000 closing cost. He had a new contract to sign, the house had jumped =

up from 135,000 to 156,000 and now he also wants me to take out a second =

mortgage for $28,000 - my 5000 would be a second mortgage for $23,000, =

all coming to almost 187,000. I was astonished at this, and then the =

man said, meet

me tomorrow and bring th 5000, it would look better if you did. I =

again repeated my statement, that is to be paid at closing. The house =

was still not finished even at Christmas. Anyway, a week later he =

callls and says I am not approved. They kept checking my credit and =

asking for check statements x 3 and everytime one checks the credit, the =

scores go down. So, now, he says my scores dropped down a few points and =

they can't approve me. Three times in 2 months, I sent in 401 K, check =

statements, bank statements and I think I should not have been lied to =

from the beginning and told that I was approved when I wasn't. Anyway, =

I am angry that I was lied to for almost 4 months. No, I was too smart =

for them, they did not get my $5000 and then tell me No, I was not =

approved. I may be old but I am not stupid. This incident occured with =

Providian Manor Homes.

You should have called the attorney general, there are laws on the books to protect you from the unscrupilious acts of these guys. You should call the Texas Attorney Generals office & the Texas Residenatial Construction Commission, there are laws on the books to protect you from the unscrupulous acts of these guys. The TRCC (Texas Residential Construction Commission) is authorized to take disciplinary action against a registered builder on several grounds. Some of the more noteworthy are: Misappropriation of trust funds, Naming false consideration in a contract, Discriminating on the basis of a protected class, Publishing false or misleading advertisements, Nonpayment of a final, non-appealable judgment arising from a construction defect or other transaction between the person and a homeowner
