Chase Auto Finance lawsuit Complaint illegal tactics; breach of contract, Regulation Z, Rosenthal Fair Debt Collection Practices Act, California Code 1788-1788.32 (RFDCPA) Chase Auto Finance miscalculated my loan charging 1000's too much in interest. Below, is information to file your complaints in the proper Jurisdictions. If you have trouble with Chase this will be very important for you to read. 4/28/04, just today at 7:21pm, I was harassed again for a different amount of $3,604.57 by a Chase Collection person who called himself Lloyd Brock TEL: 877-298-7590 x 55174. He stated my loan was going to be charged off in 2 days and I would have a negative reporting on my credit report. He harassed me for over 20 minutes. I advised him I had a heart problem. He kept talking over me. I tried to explain. He kept talking over me and rambling over and over and over. He kept talking over and over and over, he kept interrupting me when I tried to tell him about my loan and the amount. My heart started to go into Atrial Fibrilation. I finally had to hang up from the stress. 4/28/04, I was sent (3) 'Chase loan summary notices, today, stating my balance was $2,618.63. 1/2008 Andy Sulfsted, Chase VP, stated in a correspondence to my attorney (that I was forced to hire after I made over 70+ documented calls trying to get my loan straight)I owed $4,294.80 with a demand payment date end of month. Since 11/2007..., and while I had an attorney..., and until recent... , and even after Chase VP, Andy W. Sulfsted stated I owed $4,294.80, I was threatened with collection calls, collection notices of different amounts totaling approx. $17,000.00 and other amounts of approx. $18,0000.000. YES. Chase Auto Collection still would not stop harassing me and for very large amounts of money I did not owe. As you see. NO one in Chase actually knows what I owe them, but I am threatened over and over to pay sums of money in different amounts with every person who sends a letter and calls..They amounts vary by 1000's of dollars. Is this how they became so wealthy. I truly believe so. I bet my life this company has made millions off illegally stealing money from thousands and thousands of customers. Only after I hired an attorney did Chase try to correct a simple interest loan calculation in the amount of $14,609.79, which was a credit on my account. Yes, Chase Auto Finance, a trillion dollar company, that does simple interest loans for a living, miscalculated my loan to their advantage by $14,609.79. Then only after an attorney was involved did they even try to do their job. AND, still not right. Chase had charged me approx $17,000.00 INTEREST and only approx. $12,000.00 PRINCIPAL on a 9% simple interest loan. ! Chase Auto also did not set the loan up right and added approximately $5,000.00 on top of what the loan was to be. My hourly attorney is off the case. I am in the process of filing a legal complaint. This complaint will make the lady who was fet up with 'Best Buy' look like a walk in the park. I completely understand why she did it. This same tactic needs to be used against the corruption of this VP and Chase Auto. Only then, may we be able to protect each other from this corruption and Vice Presidents like Mr. Andy Sulfsted who seem to take a very relaxed laid back, no thinking, approach to their job will be fired. I'm in the process of posting all my documentation on a website and will keep you posted. I will be running a YouTube video to go after Chase Auto and find others. Also trying to find x-chase employees who will testify as to what is really going on at Chase Auto. I can't believe in America today, Chase Auto is not under Federal Investigation. My loan summary sheets etc. show they may have 2 sets of systems running for calculation. One shows payments applied correctly and with in days of receiving and the other where payments are not applied. For a year I was paid in advance. Chase did not apply the payments to my loan until a year later. They threatened me with repo then too. Here is a letter I sent by return receipt to Chase VP, last week. The collections person who harassed me this evening for $3,604.57, stated he never got it and the Chase VP is too busy for him to talk too and follow up with. However, I received the receipt back on Saturday approx 3 days ago signed showing Chase has it. I also told the collection person not to call again. He stated he could call anytime that I owed Chase money. April 16, 2008 Mr. Randy Sulfsted - Vice President JP Morgan Chase Bank, N.A - Chase Auto Finance 900 Stewart Avenue Garden City, NY 11530 LEGAL NOTIFICATION OF LAWSUIT Dear Ms. Sulfsted; RE;Loan # 100 322 13 1919 02 From the very beginning there were accounting problems, errors, miscalculations, or (I TRULY believe) just plain intentional fraud with my loan. For years I made numerous documented attempts to contact your service dept to correct these errors, unsuccessfully. I've been given incorrect information over and over again by many different Chase employees. I cried for help to understand my loan. Your employees treated me like the lowest form of scum. I was FORCED over and over to; sit on hold, transferred around, disconnected, sent to voice mails of employees that were disconnected and more. Each time hearing Chase phone recording brag; - Chase the right relationship is everything. - Your company harassed me consistently; demanding payments I did not owe- repossessed my car because I could not sell it when in hardship while very sick for years and needed desperately to get from under the inaccurate calculated $858.00 payments- your inaccurate interest over principal calculations- not applying any principal to my loan for months -and often threatened to repossess my car-It goes on.. I put a $29,000.00 initial installment on the car, on purpose, to sell without being upside down on my loan later. I was always short 5-6-7K when trying to sell the car because of your fraudulent loan. That was a huge amount to me when I had doctors bills and not working. I have over 20 credit reports supporting Chase never reported my loan accurately. Chase hired aggressive attorneys in 2005, when I was not to be in repossession. They filed (2) liens in the OC Courts prior to my 30 days to dispute and left these liens open for 3 years. The liens were filled for an amount (I now find out) I did not owe. I was harassed for attorney fees of $797.00 the entire duration of my loan. In 2004, I tried to sell the car and again upside/down on the loan by 5-6-7K, it was repossessed. I had to borrow money from a friend to get it out of repossession. I still owe them the repossession costs. Ive filed complaints and forwarded all my Chase documents in plastic covered professional binders (since the origination of the loan) for Government Agencies, other appropriate jurisdictions, including and not limited to; Federal Trade Commission, Ralph Nader, FBI, IRS, and many local & national media. I have kept ALL information on my loan and car, since the purchase, including the BMW window sticker. This is to legally notify you that I will be filling a lawsuit against Chase Auto Finance/JP Morgan. Because the errors and fraudulent handling of my auto loan was so egregious, I also intend to ask for punitive damages. Legally, I was advised, to provide you 10 days to settle this. However, I highly doubt Chase will understand the true damages this has caused me. Therefore, please forward the appropriate parties name(s) and addresses in which to serve legal documents. If you dont respond in 10 days I will assume you are the legal serving party. I am ready to proceed. I am capable of filing legal documents and motions with an attorneys supervision. I highly doubt that I am your only customer forced to stay in a loan with Chase due to your fraudulent actions. I promise you, I will find out if there are others. Im in the process of launching a U-Tube video to collect additional money for attorney/filing costs while finding X-Chase employees who are aware of your actions and posting all my documents with loan summary sheets on the Internet. If there are others, I will find them. I will ensure, no one, ever again, will have to deal with what Chase put me through. You are a disgrace to the business world and consumers need to be notified. No one in your company helped me until I hired an attorney. Regards, signed________ HERE ARE THE PLACES I SENT ALL MY LOAN - SUMMARY SHEETS, CHASE VP LETTERS, ALL COLLECTION NOTICES OF 18k+, 17+...EVERYTHING TO DOCUMENT THE ABOVE AS EVIDENCE. Chase collection person ; Lloyd 877-298-7590 x 55174 stated my loan was going to Charge off in 2 days if I did not pay the 3,604.57, it would reflect as a charge off on my credit. I told him to speak with Mr. Sulfsted, he refused and kept harassing me for the amount. I could not believe in January 2008, the Chase VP Andy Sulfsted could not even calculate my loan accurately and stated I owed $4,294.80. I could not believe even after I hired an attorney, Chase threatened me with collections of approx. $18,000.00 and another collections notice of approx. $17,000.00. They were not to contact me as I was legally represented. I was harassed for large sums of money I did not owe. I cannot believe I made over 70 documented calls to Chase since 2003, and had to hire an attorney to fix their miss calculation of exactly $14,609.79. I cannot believe in America today there are companies and Vice Presidents like this NOT being investigated by the FBI. I will find out if there are others. The Judge ordered they return my vehicle as soon as I make my 3 payments owed and NOT the $14,000 Chase wanted. They still have 3 payments not accounted for, but I will hire an independent accountant to audit their work! But at least I won over Chase! Pursue what you feel is rightfully yours! From: Message Author (click here to email author) (has asked not to receive email)Date: Tuesday, 16-Dec-08 12:45:07 CST Business: Reply Online Consumer: Comment On This Comment On ThisI had a loan with Chase Auto for a 2007 Chevy Tahoe. I found a buyer for the vehicle and confrenced him in with Chase for the payoff. Chase took all his info and applied it to my loan and thanked me for doing business with them, with a congratulations. The next day I transferred the vehicle to the new owner via bill of sale and told him I would overnight the title when I got it. Two days later I got the letter of payoff and the lien free title. I then signed the title over and considered it a done deal. 3 and half weeks later I was called by the Alabama police who told me that there were scams with buyers in Alabama and that I should call Chase and find out if my loan was still satisfied.....I was ten days past due (after they sent me my title and payoff letter). The payoff was reversed for fraudulent reasons and chase did not hold the money before knowing if it was good or not, and just sent me the title in "good faith" so I've been told. Now they say that I am around 32,000 in debt to them and almost 30 days past due. We hired an attorney and have sent a letter on my behalf. We will see what happens. I am not paying Chase a red cent....it's their fault they did not make sure the money was good before they sent me the title and letter of payoff releasing me from the liability of the lien. Chase Sucks. My Husband took video of both our house phone and cell phone whereas Chase called each number back and forth within about a 10 minute time frame at least 8 times each! I had to ask FOUR times for a pmt history from them. When I did finally get it and reviewed it, there are several discrepancies where pmts were made and then reversed! It's awful how a company can treat people and seem to get away with it! I have court with them on 12/08/08 after they "illegally repossed" my truck! But I can't afford an attorney, but WILL provide the Judge with my proof of pmts and whatever else needed! Can't wait! I hope Chase gets it good after all the similar stories I have read recently on how they "screw" their customers over and get away with it!
