Zions Bank 9-29-2007 I received Connie Linardakis' letter today dated 9-27-2007, wherein she = states that "With regards to the main issue, we have changed the record = to show that the account was closed by you and not by Zions Bank.Our = records now show account # 003462975 being closed by you." If true, = this is part of what I wanted and I do appreciate some movement on this = issue. However, I printed off the record from the bank online as of = 9-29-2007 and it still says "Bank Closed Account-Credit" and still shows = the unauthorized NSF item fee ($23.00) and the unauthorized debit = transaction ($29.95). These things ought not to be and need to be corrected. In the letter = Connie Linardakis states that ".and no attempt will be made to recover = the [fraudulently] charged off amount". Is everyone here missing the = point? What I want from Zions Bank is: 1-An apology for the way I was treated by Sherman Losee, for the = fraudulent charge off and for the lost deposit. 2-A correction to all of the record to show that there was no charge off = and this means erasing the authorized NSF item fee and the unauthorized = debit transaction and the $52.95 credit posted by the bank causing it to = appear like there was a charge off when there was not. The bank has not = acknowledged-to date-that there was never supposed to be a charge off, = but keeps repeating itself in saying that "no attempt will be made to = collect on the [imaginary] charge off"-this is no concession and gives = no comfort to me. Everyone makes mistakes, ignoring them will not make them go away and in = fact, piques interest into why Zions Bank is having such a difficult = time acknowledging and correcting its mistakes. Does someone need to = dig deeper into this bank's ethics and practices? Is this ethics = problem bigger than the bank's ability to correct it? Why are such = simple problems like these so vexing to Zions Bank? I know that the honest and ethical thing to do is for the bank to step = up and meet fully the above 2 listed items because it is the right and = honorable thing to do. Please choose honesty. This is fraud. 2-Posting, then erasing deposits is unscrupulous. 3-Posting and reversing unauthorized item fees is unethical. 4-Fraudulent reporting to Outsource Receivables and Chek Systems is = criminal. 5-Losing deposits is incompetence. 6-Refusal to reimburse for the lost deposit is unethical and = reprehensible. 7-No apology or acceptance of responsibility for lost deposit is = unethical and just plain nasty. 8-Unethical, indefensible, reprehensible, terroristic tactics used by = Mr. Losee and covered up by Mr. Anderson, Mr. Hoffman, Christa Windsor, = Kathy, Dorrie and Craig et al is criminal. 9-Inconsistent and discriminatory application of bank policy against = families and children's checks going into their parents account is = unethical and indefensible. 10-Discrimination against a person with a complaint, by attempting to = limit or terminate their bank access, limit that person to one branch, = limit access to open hours only et cetera is unethical and indefensible. 11-These tactics of false reporting are injurious, illegal, criminal and = should be prosecuted. The actions of Mr. Anderson and Mr. Losee amount = to making a false entry in a book, report or statement of the company = with the intent to defraud, injure and deceive and should result in = fines up to 1 million dollars and imprisonment for as long as 30 years. = The attempts to aid and abet these tactics make all persons with = knowledge liable to the same degree as the person who commits the crime. The attempts to conceal this felonious behavior is, in itself a felony = called "Misprision of a felony." 12-What is Zionsbancorporation going to do to address the injury foisted = upon my family and I? At the end of this email I have included some of = the wording of Zionsbancorporation, which oversees Scott Anderson and = his branch of the corporation about banking crimes. I would like this = whole matter investigated and these crimes to not go unpunished. As a person who has watched their bank account unfold = daily, I have watched as staff have applied deposits and then reversed = those deposits, applied the 23.00 reversal of the unauthorized item fee, = only to reverse that and charge off an invalid debt et cetera. This has = caused me a great deal of anguish. I want to temper my email remarks of = last night by adding that Zions staff have reversed or are reversing = most of the damage caused by Mr. Losee against his direct orders. The = North Ogden branch processed my affidavit of the unauthorized item = immediately and faxed it in the same day to the ACH dept. on 9-8-2007. = Against Mr. Losee's orders, Melinda tried to reverse the 23.00 = unauthorized item fee. Against Mr. Losee's orders, Dory and Kathy = reversed or are trying to reverse the Outsource Receivables collection = reporting and the Chek Systems reporting. Against Mr. Losee's orders = Cory of the Harrison branch did honor the $12.50 lost deposit. I never = meant to burn any bridge and the only aim I have had is to try and stand = up for what I believe is the truth. I apologize if my remarks of = yesterday were harsh, because they did not include the fact that Zions = bank staff has tried and I believe are still trying to right the wrongs = that have occurred in the handling of my closed account. I just hope = that these things can be reversed so that I can take care of my = obligations honorably and move on. If you, as the President of = Zions Bank, simply close ranks with the staff members complicit in the = use of these types of criminal tactics, you become an accomplice to all = of the above. Zions Bank should not be in the business of = interfering between minor children and their parents account--e.g. Not = depositing a child's check in their parents account without harassing = the parent and child. Please find the lost deposit for $12.50 and while you are looking, = deposit the $12.50 in my account until you do locate the drop box = deposit. Now they say that I have to sign the check and my child signs = it and then they will deposit it. We did that for a while and then were = called and left messages that Zions would not deposit the check without = first bringing the child with us to the branch, then were told that the = child's signature was enough, then that we should just have the writer = of the check make it out to the parent, then I was told to only use one = branch of Zions because I am "testing" Zions (This sounds like paranoia = to me) by using any nearest branch. Then I was told that since banking = is a relationship and they don't like complaints or complainers, that = they would terminate my banking privileges. All of these actions and = threat to terminate us as a Zions customer have really scared my family = and me. We are used to being treated in a kind and compassionate manner = over the past 7 years. We feel there is retribution going on now as the = Harrison Branch lost my deposit and will not post the $12.50 to my = account. They now say that I have to go back to the check issuer and = have them reissue a new check and presumably she would have to pay fees = to cancel the old check that Zions has lost and then have it signed by = my 7 year old daughter and myself again and then taken again to the = branch for deposit (all of which leaves me shaky and wondering why they = would not "lose" the new check as well. I know it is only $12.50, but = from George Hoffman on down, it appears that Zions bank is not family = friendly at all. As a family of eight, we have to count every penny. I am not sure if I mentioned in my previous email that I was also = concerned with the way the Sherman Losee was trying to place limits on = my banking privileges by suggesting that I only be allowed to use one = branch of Zions and that I should stop using the after hours deposit = boxes as it is better to come in person during his banking hours to make = a deposit in person. My sister agreed to = reissue another check #5327 for $12.50. I just am feeling extremely = threatened by Mr. Losee and his comment about terminating me as a Zions = Bank customer--"If you are unhappy as a customer then leave" and feel = that it is unreasonable and even unethical for him to expect me to have = my sister reissue a check because the bank lost the first one--because = if the check had been made out by anyone else, they would have had to = put a stop check for $20.00 to ensure that the lost endorsed check for = $12.50 is not passed and then reissue another check to me for $12.50?? = This just does not make any sense to me at all.
