Circuit City - selling returned/defective camera

Canon power shot SD850 IS Circuit City 13603 20th avenue College Point, NY 113566 US www.circuitcity.com On 9/6/07 my wife bought a camera (Canon power shot SD850 IS)from Circuit City for me while I was on vacation in Bulgaria. She arrived in bulgaria on 9/12/07. On the same day the box was opened by us for the first time and noted, no seal on the outer package, the battery and memory card was already inserted in the camera and the shutter lens was in the open postition. After charging the battery, we attempted to take pictures but were given a lens error message and the shutter lens would never close. We also noted the date has already been set on the Camera. Clear indication the defective camera was a return to Circuit city and re-stocked and sold to us. Upon our return to the U.S. We went to Circuit City on 9/24/07 and was told they would not exchange a defective camera they restocked and sold us, because it was past the 14 day return period. Even with providing the evidence we were out of the country and unable to return to their store, and the obvious signs of the defective camera having been re-stocked we were refused an exchange. Some Customer Service huh?, or rather "Customer Serve Us" Had the camera been simply defective and past the 14 day return period that would be understandable for circuit city to deny an exchange and for us to deal with Canon. But the camera was obviously re-turned to circuit city as defective and re-sold by them. We dont want a refund for being cheated, only what we paid for; a working new camera. I would never return to Circuit city again, as they are apparently re-selling defective merchandise, even when shown they commited fraud.
