I had a nextel phone back in 2001-2002. I ended up getting divorced and had to file Bankruptcy. I had my NEXTEL bill included in my Bankruptcy and it was approved and DISCHARGED. Every couple of years Nextel sends me back to Collections. I have to prove to them over and over again that I do not have to pay them that it was in my BK. This time it showed up under AFNI COLLECTIONS and said that I owed Sprint $1308. I called the collection agency and told them that I had filed this in BK in 2002. They asked me to send the papers to them. I said AGAIN? I do this every couple of years and every time that you add this to my credit it knocks my credit score down! They said "We have never reported to your credit before, we just got this collection from NEXTEL/SPRINT." I said "Well I have proved to them OVER and OVER again that this DEBT was DISCHARGED in my bankruptcy. I called Sprint and was hung on on 2 times! I disputed my credit report and it was NOT deleted. So finally I contacted an attorney and per the FCRA RIGHTS "You may seek damages from Violators if a consumer reporting agency, or in some cases, a user of consumer reports or a furnisher of information to a consumer reporting agency violates the FCRA, you may be able to sue in a state or federal court". So this is the route that I am taking. I am tired of them penalizing me over and over again. Its against the law and Im not going to take it anymore!
