Brief Letter Describing Lost and damaged Items


On July 9,2007 I telephoned Elephant Van Lines and spoke with Al for a moving estimate for July 21st. I explained to him the items that will be moving as follows: 6 piece bedroom set, 10 piece dining set, Glass Curio cabinet, 2 3'x3' wall mirrors, 2 Televisions 21-41, Livart Water Cooler, Stackable Washer and Dryer, Arc 5 Light floor Lamp, Coffee table with two end tables scheduled a moving date on July 21, 2007.


Al gave me a guaranteed price of $340.00. I asked him if there were any hidden costs because I would only have the balance due that day. He said none. When the movers arrived the first thing that they asked was that I would have to pay an additional $128.00 to crate the glass furniture. I told them that I spoke with Al and he told me there would be no additional costs. The driver Julio said that they would not be able to move then. I asked if that they did not move me I would not receive my $150.00 deposit back. I called the office and spoke to the manager Ronnie, he informed that if I signed a waiver for damages then they would move me. When I signed the waiver I signed it under duress. I was forced to sign a waiver or lose $150.00 and not get moved. After I signed the waiver they loaded my furniture on the truck.


When they arrived at my new address the driver requested the balance of the monies owed $190.00 and that I had to sign all the papers stating that I have no claims to damages. When I told him that I was not going to sign he said that he would not take the furniture off the truck, so again I was forced to signing the papers. They started to unload the truck; I noticed that none of my furniture was tied down. The first piece of furniture was the dining room breakfront the doors were all busted and the driver said it could be repaired. My wife was distraught when she saw the breakfront. The second piece of furniture was the glass curio cabinet, when they were taking it off the truck we all heard glass crack, the curio cabinet door cracked in half. I didn't know what to do at this time. They then took the Arc 5 light floor Lamp from the tail of the truck and drooped it to the ground and the base fell in pieces. They then took the water cooler from the tailgate of the truck and dropped it and the tank broke. They then took off the mirrors without damaging them and the TV's. They then took off the washer and dryer as they were taking it to the basement were heard a large crash and ran to the basement only to see that the washer and dryer fell down the stairs. I asked what happened and Julio said it slipped out of his hand, he said that these washer and dryers snap back together. I was so upset that I ran to the truck to take back my $190.00, but joule grabbed me. I told my wife to call the police but she was having a Heart attack. When the police arrived they immediately attended to my wife by submitting oxygen so that she could start breathing again. This was the most distraught move anyone has ever had, a Moving company that would steal from 2 disabled Senior Citzens.


Also there was a Panasonic Cordless telephone stolen worth $199.00.
