Illegal eavesdropping

Credit Card Capital One PO Box 30285 Salt Lake City, UT 84130 US http://www.capitalone.com I spoke with a "senior account manager". I called to complain about illegal eavesdropping by a Capital One employee. I was told associates would stop a call from being recorded if the customer asked. After such statement, I called a few associates to confirm this is the case, but I was told calls our randomly recorded and they did not know or could not stop a call from being recorded. One associate confirmed a call was being recorded but said she could not stop the recording. Under Utah law: "Utah Code Ann. § 77-23a-4: An individual legally can record or disclose the contents of any wire, oral or electronic communication to which he is a party, or when at least one participant has consented to the recording, unless the person has a criminal or tortious purpose in making the recording." They don't need your consent to record, they don't even have to advise you of this; they are a party to the conversation. It's done to protect themselves, to keep you from lying about the conversation, if you were inclined to do so, and I guess to maybe hold you in check if you were inclined to yell, curse, make threats, etc. It doesn't bother me, I let them know (even though I don't have to either in Texas) that I'm recording the conversation too. A $7 suction cup phone mike hooked to a digital recorder works great.
