Mortgage Loan Chase Home Finance 770 The City Drive South Orange, CA 92868 US chasehomefinance.com I have been a Customer of Chase Home Finance for 3 years now. They Purchased my loan from New Century Mortgage after my 1st year in my home. Every payment I have sent in has been mailed 2 weeks before they were due, and every one has been held 20+ days before they even attempt to deposit them. This has made every payment LATE, so they can charge more interest and more late fees. THIS IS NOT FAIR!! It's not my fault they can't process my payments on time. Today I received a FORECLOSURE LETTER!! And I also received my check dated 8-25-2007 for my September payment that they held until 10-22-2007. Are these people Crazy?? I have been given over 11 phone numbers to use to contact people that only have Voice-Mail, and NEVER return my calls. Not even the Foreclosure Department has returned my calls. I guess they need a write-off or something, maybe that's why they are determined to take this house back. Damage Resulting This has ruined my credit due to them not posting my payments as they should, and I have had to Stop-Payment on my last 2 house payments because they are still floating around somewhere. They say they have not been received. They want me to pay it over the phone, except now they want all past-due payments "That they have screwed up" plus another $1500 in attorney fees, plus another $1700 in more BS Charges. I did not choose chase as a lender my original mortgage company centex mortgage sold our mortgage to chase not even 6 months after we moved into our new home. After my wife hand several bouts of long term unemployment due to the recession we were struggling to make our payments. We contacted Chase and were told we could apply for a Loan Modification. After over a year of chase losing the forms we would fax and mail to them and multiple failed attempts to contact anyone that could give us a straight answer about the status of our Loan Modification application, we finally resorted to filing for Bankruptsy (not inluding home loan or vehicle loans). We thought it would get us back on track. My wife again lost her job and we were falling behind again. We contacted Chase again and this time we were told thier process had changed and we gave a brief run down of our income and expenses and were told over the phone that we could make 3 "trial period" payments at a lower amount (determined by Chase) and durring that time we would complete the Making Home Affordable Loan Modification application. Chase said that we would be told durring this time if we were approved for a permanate reduced payment. We never recieved anything in writting about it, and when we asked why we were told a packet explaining everything was going to be mailed out. We still never recieved it. However, we made every "trial period payment" on time and still had not heard back from Chase. My wife and I began calling several times a week to find out the status. Every time we called we would get transfered around to several different departments, hung up on, and treated rudely. We sent an additional "trial period " payment amount on what would have been the fourth month, even after we were told by one Chase employee (durring one of the many phone calls to them) that we had fullfilled our obligation to the 3 "trial period" payments and now we were in a "protective bubble" and not required to make any payments until we heard back from them. We continued calling several times a week at one point my wife was told to call a specific extension to talk to the person handling our Loan Modification. When she called and could not get through with that extension she contacted Chase Customer Service and was told they had not had that type of extension for several years. It became obvious that Chase was jerking us around and/or we were dealing with a fraudulent system. We were not recieving regular statements durring this time and could not be sure our payments were even being credited to our account. We stopped sending payments to them and waited to hear from them. 3 months after we stopped sending payments they finally sent a generic looking letter stating we did not qualify for the program and all back payments were due including the difference of the "trial period" payments and all late fees associated. It was nearly 10,000 dollars, and the letter said that if we did not pay it within 30 days they would foreclose. We contacted Chase explained to them we could not come up with that money and that if we had it we wouldn't be in the mess of it to begin with. Chase forclosure department said we could do a Short-sale or a Deed-in-lieu as another option. We since have put the house up for Short-sale. We had an offer almost 3 months ago and Chase is now stalling, holding up the buyer's offer in "processing". We have tried so very hard to keep our home, to do the right thing and pay what we can especially now that my wife's income is much more steady (even though it is at a significantly lower pay).We have jumped through their hoops and are tired of being jerked arround! We feel like Chase changed the rules mid game and was fraudulent. Chase has continually had unfair business practices and at the very least recklessly misinformed us and probably millions of other honest hardworking families!

They immediately lowered my payments for several months, which created a growing past due balance. Eventually they asked me to pay the full amount again, which I did. I have always paid on time, and the full amount of our agreed monthly payment. I have just been told that they aren't going to complete the loan modification, and they are going to foreclose because of the unpaid balance, which they authorized. I believe they have some responsibility to help me find a way to resolve this, not just foreclose. Then denyed me the modification, and then raised my payment to three thousand dollars a month, witch i paid 5 of them and in 2010 alone i paid 23,000 dollars into chase. and now they just gave me a notice they are intending to forclose on me. Last November (2009), finally someone told us that they have not received any of our documentation and there was no record in the bank���¢�¯�¿�½���¦.Right then and there she has arranged for a quick interview and said we qualified for the program. She has said that we were ready to enter a trial period of three months (we make 8 payments on time of trial Nov thru June #1) but we had to resubmit all of the paperwork that has already been previously submitted by us. On December of 2009, We received a letter said the our trail payment has not been received. We did paid by phone on December 10th, we kept receiving this type of letter and if you see we did paid on time all the trial period.(copies attached #2). We have kept calling every week or two to check on the status of the process with no resolution. In the meantime, they kept asking us for copies of our 2009 tax returns even thought they had a signed authorization to check with IRS. We have faxed those taxes at least 10 times to the Bank and each time we called to check with the bank and got confirmations of receipt from the people on the phone(copies attached #3). The time has passed by, we kept calling every week. In May 26th of 2010 we received a letter that we didn���¢�¯�¿�½�¯�¿�½t get in the program Home Affordable Modification because we didn���¢�¯�¿�½�¯�¿�½t provide them with the documents that there request in the time frame. (!!!)(????). (copies attached #4). Mr. Senator, you have no idea what the level of my family���¢�¯�¿�½�¯�¿�½s frustration is. That was very exciting. Mike made my day. Several days later, at the end of June, we finally got the contract. They were going to reduce our payment from $1064 to $818.82 The contract explained that for seven years, the payments were going to be fixed at $818.82 and subsequently would go up but not to the original level of payment.(No copies of the contract , we send the all package sign and we never received our copies back) We were telling our friends that the program works, and that it was worth keeping up communication with the Bank no matter how frustrating the process was. Each time I called, it took me up to an hour to get through to someone. On July 15th, The bank cashed the check of $ 818.82 that we send with the contract, the call a quick payment(copies attached #5) and they advised us that our ���¢�¯�¿�½�¯�¿�½first payment���¢�¯�¿�½�¯�¿�½ was to be August 5th. We signed the direct deposit for the new contract ($ 818.82) It was established in the contract. We kept calling the entire time to check on the contract status as we never received a copy of the new contract from the bank. Each time we called, we were told, we were approved: ���¢�¯�¿�½�¯�¿�½please do not worry about this, you are in the program���¢�¯�¿�½�¯�¿�½ now your first payment is going to be September 5th. The problem arose when our funds were not taken out of our account for the mortgage payment ($ 818.82). On September 7th there was an envelope received by us - turned out, Mr. Senator, there was a same contract with different numbers (copies attached #6). Now our payments were going to go up from $1068.66 (original payment) to $1071. We called once again; they told us that there was a mistake in their ���¢�¯�¿�½�¯�¿�½system���¢�¯�¿�½�¯�¿�½. We call Chase and asked whether we had a choice, they said no. What a joke!( Our economic situation was and still the same) We didn���¢�¯�¿�½�¯�¿�½t sign the second contract. Chase kept sending us bills for $1067.99 (the trial amount), each time we paid on time November, December (copies attached #7). On December 9th of 2010, the day of our 32nd wedding anniversary, we got 8 certified letters and others 8 letters in the regular mail (copies attached #8), said that we were in default because we failed to pay the required monthly payment since 03/01/2010. And if we don���¢�¯�¿�½�¯�¿�½t, pay within 32 days of this notice, Chase will accelerate the maturity of the loan. We are attaching copies of all the payments in 2010(copies attached #9) only 3 payments are Missing: August, September and October, this are the payments that Chase was supposed to take from our account, but the took July���¢�¯�¿�½�¯�¿�½s payment (direct deposit $818.82) as per their initial instructions. Mr. Senator, this is our last hope to have justice. We are not the only people in this boat. But we feel that it is our duty to inform you what American Families are going through on a daily basis. As you know the banks are hiring people with no experience and they give no training at all. And we the people are paying all the consequences. This property was sold in feb 2009. To this date, almost two yrs later, chase refuses to update my credit info with the bureau showing that this acct is closed with a zero bal. We notified CHASE. They then held all our money in "suspended funds" and began saying we were late. They nailed us with interest charges and such. Chase kept sending us bills for $1067.99 (the trial amount), each time we paid on time November, December (copies attached #7). On December 9th of 2010, the day of our 32nd wedding anniversary, we got 8 certified letters and others 8 letters in the regular mail (copies attached #8), said that we were in default because we failed to pay the required monthly payment since 03/01/2010. And if we don�t, pay within 32 days of this notice, Chase will accelerate the maturity of the loan. We are attaching copies of all the payments in 2010(copies attached #9) only 3 payments are Missing: August, September and October, this are the payments that Chase was supposed to take from our account, but the took July�s payment (direct deposit $818.82) as per their initial instructions. Mr. Senator, this is our last hope to have justice. We are not the only people in this boat. But we feel that it is our duty to inform you what American Families are going through on a daily basis. As you know the banks are hiring people with no experience and they give no training at all. And we the people are paying all the consequences. We are so tired of all this�game�the Chase as be playing with us for almost 2 years. Please Help Us!! I tried for a modification on the suggestion of Chase 2 years ago. I doubt anything can be done in my case but hope to help others. I have a VA loan, When I tried for modification was first rejected for not making payments. I reminded Chase they were the ones who told me not to make payments during the process. Due to their rules, I didn't make payments and then penalized for that. I then was told to redo the application which I have done at least 5 times if not more. I would get a "trial plan" and snd start making the required payments. After 1 or 2 payments I would be contacted and advised the plan denied for reasons I had no idea about. Like not turn in paper work (which I did same day of application) or or for missing a payment. This occasion I was sent the plan on July 17th and then denied for not making the 1 July payment I didn't know about. Each time I did the process it would take months for them to do anything and told not to make payments during those times. Now my house is to be sold at auction on November 30 which I just found out about a couple of days ago. My lsst app for modification turned down for not making at least 12 psyments, never mind I was told not to make them or when making them told to stop as they found some obscure reason to deny the modification. Top it off they ruined my credit as they reported me late on payments even though they are the ones who told me not to make them. This is just plain fraud on the investor and Chase part. My name is Mark Chandler and have been trying to modify my home now for 2 yrs. Last April of 2010 they approved the Mod and I paid them starting in April for 4 months. At that time I received a letter from Chase that my Mod that was APPROVED was taken away from me for the same reasons of many of these other people. They said it was denied after being approved because of some paperwork that they did not receive and was not signed by my EX wife that is not even on the loan! It, the home was awarded to me via the divorce and I was approved with my own income in April then taken away because they would not continue to let it go thru because they wanted my EX wife's sig on the paperwork to! I am a liver transplant patient and all this stress now has cause my kidneys to take a hit because of the stress they have caused me concerning this matter. I obtained a Lawyer Last Oct of 2009 in which he got the Mod to go thru in April and was just so pissed when he found out they took it away in July after I had made the 4th payment on the approved Mod! So he again started the process all over again and this time I had my EX sign the paperwork but it is the same thing all over again. They wanted proof of her paying me Alimony in which I sent over to them court orders saying that I am receiving $650.00 a month from her and my renter agreement of 6$600.00 per month as well! They are telling me that both are not proof enough and they are going to deny the whole thing again! I do not know what to do next as it just seems they will not work with me on this matter and want my home. I have nowhere else to go and on a limited budget but able to qualify for their mod with Pension, Alimony, Social Security and Renters payment which make my total income of about 3,200.00 a month! We have submitted every piece of document they've requested practically every 60-90 days for a loan modification. They ultimately denied our request for a loan mod due to incomplete pages of our bank statements which could have easily been re-submitted since they were also the ones who misplaced it. Same treatment, same excuses, no one at Chase EVER having the same story to tell you. Paid forebearance amounts for 5 months just to be told I didn't qualify. I have written to the Senator of VA 2x, Governor of VA 2x, OCC 2x, BBB 2x, The White House 2x, NAACA 2x, and others I can't even think of right now to no avail. It's very sad to see that big lenders can get away with this kind of underhanded, illegal tactics and there is nothing the "little" peopel in the world can do about it. Got into some trouble last May, asked for an extension on the mortgage payment, was offered a loan modification with trial payments for 6 months at a rate about $1,000.00 below the current mortgage payment. Of course, we said yes because the value of our home is $175k below what we owe and thought it would be good idea to modify the loan. They jerked us around for 8 months, took our money, told us in January that we had qualified for a loan modification. We never heard a word, phone calls when unanswered, when we did get someone on the phone, they knew nothing about what was going on, and they would not accept any more payments from us. In April they told us once again that our modification had gone through and we would be receiving all of the paperwork to sign and return. Now mind you, we have been paying the second mortgage all along while this has been going on. Two weeks after Chase told us we had been granted the modification, they SOLD the mortgage to another lender, Wells Fargo, which is managed by Quantum Servicing. It is now 4 months later, we have had to resubmit all of the modification paperwork to Quantum, who advised us last night that they could not entertain a modification and would begin foreclosure proceedings or discuss an exit strategy with a payback of any delinquency of the mortgage. This has been a freaking nightmare. I DON'T SLEEP at night, I am ill over all of this and my next stop will be a bankruptcy attorney. Chase did this to us and we are still paying the second to them. If there is anyone out there who has started a class action lawsuit against them, please post it somewhere on the web so we can join in. I also called the Ohio Attorney General and subsequently filed a complaint (there were 160 other complaints listed under the address in Columbus. All were aware of these practices, but can't fight for individuals due to law. I did get a call from a nice guy at Chase, Chris Elliott and he looked into why I was declined. The info said I didn't send in all of my information and he reviewed the scanned documents and said that the form in question WAS completed and he couldn't figure it out. He went to the executive level there and asked what can be done and they said since IBM took it over then we need to deal through them. I will be contacting a local attorney, as my state Attorney General gave me the name for free legal advice in my area specialized in these matters. Damn, I am so pissed. My credit is ruined by these guys. The most recent activity was to make our September payment to IBM Lending Services and they wouldn't take it. Said we needed to complete all of the paperwork - I did it twice already, so here we go again... Oh, additionally, go to your local branch and ask the manager (politely explain the situation) and ask them to make a call and get a print-out of your payment history for your mortgage. I included that in my letters listed above. I am only trying to change my mortgage from an ARM to a fixed rate. Whenever I called for a status, no one could tell me anything. I finally threatened suit and was assigned a specific person. I learned my modification was denied by Chase's collection department calling me at work - no written notification, no phone call from the person I was dealing with. Mind you, Chase could never call me with a status at my work or to let me know they needed additional documentation, but their collection department did not hesitate to contact me at my work. I have still received nothing in writing from Chase regarding the modification being declined or what the next step is (i.e., catching up payments, appealing decision, etc.). The only contact I have had is the one phone call from the collection department demanding immediate payment of all past due sums. I applied for a modification June 2009 and was later told in 2010 I did not qualify. After sending the packet for the modification several times thru fedex and fax. My wife and I live in Sellersville PA and we have been going through the same thing with Chase. WE have a 1st and 2nd loan through Chase. In November my work completley fell off the map. I am a self employed contractor for new housing. We called Chase right away to ask them for help they said we needed to pay something to the loans so we made partial payments as directed to by one of Chases reps. After we sent them the checks they cashed them and said they couldnt apply partial payments to our loans, and there was nothing they could do to help us untill we went behind 3 payments. Well unfortunately my work still hadn't picked up and I couldn't make partial payments to them because they wouldn't apply them to my loan. Well 7 days after my 3rd missed payment they sent me a certified act 91 letter stating they were foreclosing on my home. Chase wasted no time getting that letter out to me. So at that time I contacted the Bucks County Housing Group and made an appointment to stop my foreclosure on my home. When they called Chase they put us in for the Obama plan and sent us all the paperwork we filled it all out sent it right back to Chase in the beginning of Feb 2009. We called Chase the next day after we faxed it and a Chase rep said they Received it all and are reviewing it. Well in the mean time they gave us a forbearance for a lower payment untill they reviewed the papers we sent them. We were told by Chase in the mean time just pay the forbearance on the first dont worry about paying on the 2nd loan through them It will fall in line for a modification when the 1st is finished with there modification. So we called and spoke with someone from chase on the 2nd to make sure this info was correct. The 2nd said that was correct dont pay till the 1st was adjusted. A month goes by no calls from Chase we called them they said its still being reviewed by them call back in a few weeks. We Called Chase repeatedly for the next several months and were told the same thing its being reviewed. Chase never called us we always had to call them and every time we were faxing them new documents bank statements and everything else they wanted from us we kept all fax conformations and copies of everything we sent to Chase. Finaly they said there was paperwork in the mail for trial payments for 1,470 we were approved for the re modification under the Obama plan just make the 3 monthly trial payments they started in nov of 2009 note that was almost a year after the 1st missed payment. Every month we sent the Payment 2 weeks early they cashed them always on time we thought the worst was over. After the 3rd month of the trial payments I called Chase of course to see where the paperwork was in there system. I was told by Chase it was in underwriting just keep making extended trial payments untill the final paperwork was sent out for us to sign. That was in the beginning of march of 2010. At the end of March We contacted Chase again. I was asked to Fax a copy of some tax form that we had already sent them 5x. I faxed it to Chase within an hour of me speaking to them. Anyway the same day I called them we were told by a Chase rep within 7 days the final paperwork should be mailed to us from the underwriter just sign it and it will be complete. All of the sudden we got a call from a collection agency for the 2nd loan for lack of payment. I called them right away and said there was a mix up we were told not to pay on the 2nd by Chase untill the modification was complete because Chase was going to adjust that payment too as soon as the 1st one through Chase was complete. The collection aency said there was nothing they could do so we called Chase and they said they would not review it with me because they sent it to collection. So I called the collection agency again and they said they would let me make payments for 6 months than they wanted 92,000 dollars in full. "ARE THEY NUTZ" 4 Days later we received a letter stating we were turned down for the 1st loan remodification for a lack of a tax form that we sent to Chase 5x and we sent them copies of our 07 08 and 09 tax returns 3x. So now in June of 2010 I received a letter from Chase again saying they will give me a 3 month forbearance again and that I can not re apply for the Obama plan again. When I was turned down for documents that Chase said we didnt send them but I have fax conformations and copies of all the papers that were sent to Chase 5x over. The end result from listening to incompetent people over the phone from Chase is now my house is in limbo, I have 3 kids that are all upset that we might half to move them from there friends and schools a wife that is all stressed out and my blood pressure is through the roof, collection on a 2nd loan for 92,000 dollars from Chase that I was told by Chase not to pay on till the modification was complete on the 1st loan, and all this time the arrears on my little 250,000 dollar ranch house are at 29,000 and Chase is making it so I cant catch up. Someone tell me where to sign for this law suit and whom we need to contact Please. All we asked for was a little help its not like we dont want to pay our bills but now they have made it so hard that we will never catch up. In November 2008, we received a signed re modification from Chase and made the first payment via western union. We then got a letter from western union that Chase would not accept our payment. We called them and then sent the money again. This went on the 3 months and then we got a notice of default. Once my husband finally got to speak to someone, they told us the apply for the new Obama modification program. We did and then was told of our new monthly payment. For 10 months we made the payments on time. We then got the modification papers in the mail. Chase did not apply any of the mortgage that we paid since November 2008, added 45,000 to the loan and added 5 years to the loan.In addition, our mortgage went up $1,100 per month. When we called to question all of this, they sent us a list of all of the fees that added up to the 45k. The statement they sent us only added up to 30K and included all kinds of things like attorney fees, late fees etc. We then call and spoke to yet another person, they sent us another statement of fees that had a totally different amount. We were advised not to send any more payments. We went to an attorney to stop the foreclosure and have a court date on the 16th. If I can I want in on this class action suit as well. At the beginning of the loan mod process - They never informed me that the loan modification payments would be considered less than an actual payment, thus making me have "rolling lates" - consistent late payments. The loan mod process is still not complete! I had no idea about predatory refinancing/ or loan modifying until now. The only thing is that I don't live at the property address!!! It is a rental (I'm living with my boyfriend because I can't afford the payments) my tenant lives there. So the letter was returned to chase. I never saw that letter ever. A month later, the next thing I see is an Accelerated Foreclosure letter sent to my Mailing Address (where I actually live and they know I live there!!) stating that I haven't made a payment in 15 months!! This is untrue as I have been making the advised montly "trial payments" based on their guidance. Only the trial payments are less than optimal and not a full payment - leading to delinquency!! So, when if/when I finally get a new interest rate with this Phantom Loan Mod- it will be based on a higher rate based on poor credit showing "delinquent rolling lates." We needed help with our house payment until my disability started to pay. We called Make homes affordable they couldn’t get us in their program, but Chase put us in theirs for modification program. Chase Mortgage is horrible. They do nothing put harrass the customers. We have had our mortgage with WAMU for over 20 years. Paying extra every month to principle. When Chase took over if the payment is not received by the 10th they start harrassment calls every hour on the hour til 9:00PM at night telling me my payment is late and when they can expect payment or if I could make a payment over the phone to them. I have always gone into the bank and paid my payment on or no later then the 16th of the month which is the last day of my grace period. I am so through with this bank and something needs to be done. They solicited me for a Mod program...told me all was well ("looking good...you should have no problem being approved")for a yr after making every payment on time and putting me through a financial stress test of sorts...and they rejected me in the end and are now telling me that I am two months behind. For over two months, I have been faxing and writing asking for my complete payment history. It finally arrived yesterday (after two months of requests). Forget calling, getting transferred around and hung up on! Notwithstanding the dopes that they have answering the phones...asking you for everything from your mothers maiden name to "do you occupy the residence?" and then telling you that you have reached the wrong dept...and dumping you back into another phone cue! Also, keep on eye out for Spokeo.com. They must be on the shortlist of CA suits. they take info from Amazon, Facebook etc and put it into a white pages of sorts. Check your own info...you may be shocked...they say you can remove your info, but they make it near impossible. They screwed up the original loan and then after the papers were fixed they continued to charge us the wrong amount and then take our payments and put them into "unapplied funds". They of course reported this against my credit meanwhile destroying my score. We were told to once again get a modification and after loosing my paperwork 15 times and taking 8 months I am told I don't qualify because we make too much money and oh you don't qualify for this because you don't make enough money. Funny our modification came back and they RAISED the payment by $500 even though my husband is a small business owner and our income was cut more thn in half. I am a teacher and we all know what the government thinks of education. Can you say 1.2 billion cuts in education in the good old state of MO. Anyway, Chase claims that if we can't make their crazy payments they will simply take my home. Well they can have it and choke on it. I agree with the lady that said the day of reckoning will come. I used to work for a bank and in this department they used to give out a false name of a woman as a contact because no one wanted to take the complaint calls. There was even a department letter that was sent out with her name on it. I am under the belief that Chase is doing the same thing. We were given names and phone numbers to call of people whose voice mails were always full. We have had people from other countries calling us trying to collect money which was the difference of the amount we were paying during our "trial payments" and our original payments. They told us the amount to pay for our trial payments, yet they have collectors calling us for the difference?! We are not doing anything or believing anyone on the phone any more since the stories change from person to person on any given day. How could a bank be so messed up? Don't they have policies and protocals to follow? It has really turned out to be a joke, but no one is laughing! We were told yesterday by one of those callers, that our modification loan was denied. Unless we receive something in writing from the bank I'm not buying it! I cannot believe that Chase would allow people to lose their homes and that Chase would even take a hit as well, were in the logic in that? All of these homes are vacant, who was the winner in all of that? After becoming behind on my mortgage I called Chase for help. They informed me I was the perfect candidate for the "making home affordable" program and they would send me a packet in the mail. I filled out the paperwork and attached all the documents requested and faxed it back to Chase. A week or two passed and no response so I called to follow up... I was told the paperwork was being processed and could take several months to complete. They then informed me that during this time they would put me in forbearance and to make payments via cashiers check for $790.65 (which is $60 higher than the reg. payment) on the 9th of every month. I thought it was strange that they wouldn't accept a personal check since I had written a check to them every month for 4 years and never bounced a single one, but I went with it thinking I could trust them. I also couldn't understand how raising my payment was helping me I received the forbearance paperwork signed it and mailed it immediately. I called every month as instructed to report my payment and check on my mod. Every month I was told everything is fine, still processing, keep making your payments. After Oct, Nov, Dec, Jan, Feb passed and still no mod I called to find out what was going on. This was yesterday and I called to report my payment and get down to the bottom of it all. I spoke to Anthony and was told I claimed bankruptcy on Jan 15th. I may have lost my job but that doesn't mean I claimed bankruptcy. I explained it was so untrue and how did this get put on my account. He was very unsure and was going to get this fixed right away. He checked their bankruptcy listing and confirmed we had never claimed or filed for bankruptcy. He also informed us that this error kicked us out of the home mod program and there was a scheduled sale date for our home on March 18th. I was angry. Was he telling me that struggling for the last 5 months making a higher house payment and thinking we were going to get modified all for nothing and now we are losing our home in 10 days. After talking to his supervisor he told us he was emailing all the underwriters and their supervisors and we would get this mod to the top of the list. He also said that he had stopped the sale and we should make our next payment of $754.78 on April 1st. I was feeling a sigh of relief until tonight. I received a call from Chase to inform me that I do not qualify for the mod program because I lost my job. I was so confused my wife is employed and they had our check stubs and information for months and they are the ones that told me we needed to do the mod in the first place because we were “the perfect candidateâ€...what is going on. I am getting unemployment benefits and actively looking for full time employment. We have been doing everything they asked including making these larger payments on time every month since September. She said the only thing they could do is put us back in forbearance "IF APPROVED" or pay $4442.41 plus fees. I feel so violated. If I come up with the money to pay all of this to keep my home how do I know they won't sell my house anyway? I can't believe they are getting away with doing this to people. I have been on time for 4 years and now that I need their help I am just screwed. If I knew this was going to happen I would have never gone into the mod program I would have just found a way to get current. I thought the mod was the best thing for my family and the Gov. has been funding these programs for to help people. I feel like a little fish fighting a lion please Help!! My new "modified" loan is a whopping $46 lower than the original loan that caused me to go into foreclosure. Chase raised my monthly payments $1300 from my trial payment. To add insult to injury, Chase added nearly $39,000 to the back end of the loan for "missed payments" while I was on my trial period. Numerous calls to Chase result in voicemails or vague answers. FHA, I was told that at that time they could not do a modification and Gave me a 3 month Forbearance 0 dollars. At the close of the 3 months, I recieved a letter from Chase that I had tto sign for at the post office that I was going to be forclosed on if I did not pay the 3 months due. Also a letter aabout project Hope to help homeowners with there mortgage problem. I called that number and set up appointment to talk to them. It was a local Consumer couseling company. I also called Chase at that time they said that the letter was sent out by mistake. That thousands of these letters were sent out. When working with the cc company in August they were going to communicate with Chase . After 1 month I called the cc company and the women told me not to bother them , that if they had some info they would call me. That unless I received a date for Sheriffs sale of the home I could call them. Well Chase sent me papers that I have a new 4 month 0 dollar forbearance. In January 2010 I started getting calls again from Chase that The forbearance was over and they needed my money Now at 13,000 Plus dollars, I said I do not have the money and that I was working on a Loan Modification. They told me that it was denied and that I had to pay the money. At that time I called the CC company and the women asked me did chase send me the forms in September for the Modification. I told her only the forms that we filed together in August . Well she had me pickup the package from her Office. Which I promptly filled out and attached all the information that Chase required. and mailed it Fed-Ex on Feb. 4th 2010. Well two days later I got a call from Chase Home assistance and she wanted me to fill out this information and send it in. I explained that I had sent it out already. After I recieved a tracking notice that the paperwork was delivered, I called the FHA branch of Chase and was told that tthe paperwork was recieved and to call back in 10 days to check on it again. Well Today Feb. 25th I recieved a letter from Chase that I was in default and needed to pay the full amount in arreas or I Would be reported to the credit burea and a possible Foreclosure Recommendation. This letter was dated Feb 15th. Today I called Chase again and was told that the Mort. was sent to attorneys on the 24th for Forclosure and they have a date of Sept. 9th for Sale of my property. So now I am waiting for a letter from the Attorneys about a Reinstatement of my Mortgage. I have 401 k Money that I will have to take out to make my mort. current. And I recieve no Loan Modification at this time. and Will have to look for a new Mort. company , the only problem is I have been reported every month to the credit Burea so I may not be able to get a different Mort. from a diff lender. My homeowners was cancelled, and this started a snowball problem. Chase then ran my escrow and said they paid the homeowners 3 times. That took 4 months of 3 calls a month to correct and get the correct escrow and new payment amount. Then they misapplied my mortgage payment which showed I didn't make a payment and had their collection agency call me. I escalated that and finally found a group that handles 'red flag' accounts. She corrected the payment, but this month (the very next month!) I noticed I never got my bill, when I called them yesterday they AGAIN misapplied my payment and were going to send a report to the credit bureau in a week! Again escalation and again apologies and b.s. This has been going on for 6 months now. My question to everyone I have spoken to at Chase has been, if I made all these mistakes paying YOU what would it have cost me?? I feel they should reimburse me SOMETHING comparable to the late fees they would have charged ME if these had been my mistakes, or lower my interest rate, but of course, they are SORRY but can't do ANYTHING like that. If this ends up on my credit report I am filing a case against them. 6 months of nothing but mistakes. Definitely going to move my mortgage to my small local bank. AND a friend a work has the same problem with Chase mis-applying the car loan payments, and claiming she missed payments. If you have ANY accounts with Chase monitor them carefully!!!!! It was only until I took it upon myself to be proactive and follow up with Chase in regards to my Home Modification Package. Only after many phone calls and unanswered messages I was able to get a hold of someone who tried to explain that my package was never received. I found that hard to believe due to the fact my $2,021.00 check had already cleared my bank back on June 25, 2008. The check was attached to the modification paperwork. Interesting that Chase Home Finance never received my modification package but was able to cash my check. Things that make you say "HMMMMMM! This is where things started getting really out of control with Chase Home Finance. Instead of investigating what happened to my original modification paperwork. Only after dozens of excuses and threats I did receive a very strange answer what happened to my loan modification paperwork. A gentlemen who called himself LJ explained that around the same time my paperwork was received Chase Home Finance Corporation had an internal system upgrade and thousand of home modifications were lost due to this upgrade. He urged me to resend all my copies of the home modification to him and the Home Preservation Office. I am sure the Home Preservation Office was developed to handle the influx of loan modifications that Chase Home Finance was either screwing up or not keeping up with..... The HPO wanted me to start all over and send a new hardship letter, tax returns, pay-stubs, bank statements, etc. Luckily I had most of these requirements already together because of my first go around with Chase Home Finance. The entire time I was dealing with the Home Preservation Office I was getting very aggressive and even threatening calls from Chase Collections Department. The HPO was very aware of my original modification and I sent them copies of the original paperwork, cleared check and DHL receipt. The HPO first attempt was to see if Chase Home Finance would honor the original modification due to me producing all documents and the cleared check. Chase Home Finance reply to the HPO was "NO." Their decision was based on the fact that the original loan modification had expired. These funds were sent via certified check from BB&T. I recommend any future and present home owners seeking a loan modification with Chase Home Finance to expect the unexpected and make sure you document everything you send them. I then joined NACA (www.naca.com) in Oct 09 and they are doing everything they can for me, but WAMU/Chase has shown negligence and appear unwilling to cooperate, although legally contracted with NACA to offer solutions to this mortgage disaster. I now have a sale date, which NACA is capable of stopping, however, I am losing hope. I have read all these horror stories and I am so disgusted with the fact that Chase Home Finance has been able to get away with all of this. I am also a victim of their schemes and now because of them I am behind on my mortgage and have been threatened with foreclosure. I am in my second loan modification process with them and ive had to hire an attorney to take care of this for me, hoping that this time, Chase will feel more pressured to comply with modification request. They are horrible at returning phone calls yet at times, their collections department calls me at least 10 times a day demanding payment. I had to request a loan modification due to financial hardship from divorce. I want to keep my home but they have made it increasingly impossible for me to do so. Ive been fighting with them since January of 2009 and Im sick and tired of hearing excuses. They told me that my first modification was denied because my hardship was "temporary". If someone could tell me how a divorce is a temporary hardship, I would love to be enlightened!!!. I am certain that my credit is also been affected thanks to them. This is something that I am currently following up on with the credit bureaus. I asked for them to refiance my loan, like what Bush and obama had passed for hope of home owners. after a year and a half, they tell me we do not quilafiy, but do not tell me why. they told me to keep sending my payments in and sent me three payment couponds to send in with my check. I sent in one with a check and they cashed it and the next month i sent in a nother check and it never did clear, and it was about time to send in another payment and I got the check back and they told me they could not except checks to send ceritified funds, i called about this and talked to some guy, and he said he did not know why they did not except that check. So the next payment i sent cerif. funds and a copie of the check they exceped and the one they sent back. and i ask why. no answer. also sence i did not except there contract of more money a month and 10.50% intreset rate. they are forcloseing on me and I have asked for copie of all my payments and where the money has been applied to. and a break down of the charges they are charging me. Then, within a year of the re-mortgage, Chase sent me another letter offering to reduce the APR from 6.5% to 4.5% and I jumped all over it with a clear understanding that I would only pay $390 out-of-pocket, period, which would be refunded when the loan closed! Since October, I have been demanding that the loan close and Chase ignores all of my emails and telephone calls! Furthermore, they now advise that I will need to pay more money at closing! When I bought my 123-year-old historic home in Ft. Worth, TX in 2003, the note was immediately sold to Chase. It was an ARM, and the contract specified that Chase could only raise mortgage payment every 2 years; however, Chase began raising mortgage payment immediately & continued doing so every 6 months until my mortgage payment went from $635 a month at beginning to $1,350 in 1-1/2 years. Then, when we could no longer pay mortgage, Chase sent us foreclosure notice. We immediately found 3 definite buyers who wanted to buy the house and were competing with each other to do so before foreclosure. So we could have sold it prior to foreclosure and gotten our equity out of the house, but Chase consistently and aggressively refused to give us the payoff amount on the house so that we could sell it. In a phone conversation with a Chase rep about the situation, she told me emphatically and extremely cruelly that Chase would refuse to give me payoff amount so that I could sell it to one of the 3 buyers who were competing to buy the house from us before foreclosure and, further, that Chase was going to see to it that we were foreclosed on. Chase never gave us the payoff amount on the house, it went to foreclosure, and Chase bought the house themselves. We lost all equity and now have to live in a rent house in a very bad part of Ft. Worth and cannot buy a new house. This happened in December 2006. I am a paralegal but none of the attorneys I worked for wanted to deal with the problem, so I'm trying to find out if statute will still allow me to file my own lawsuit or better, join a class action suit. One way or the other, by hook or crook, I'm going to get even with Chase for ruining my life, even if it takes the rest of my life to do so. The house was on the Texas State Historic Register and was a City of Ft. Worth Landmark, with bronze plaquez on the outside of it designating it as such. It was a very valuable piece of history which we worked hard on to restore and live in for the rest of our lives. Chase literally stole it from us with their breach of the ARM contract by raising our mortgage payments every 6 months instead of every 2 years as provided in the contract, then refused to allow us to sell it just prior to foreclosure when we had 3 definite buyers for the house. Specifically, plaintiff was advised that if his signed agreement and payment did not reach Chase by June 27, 2007, a sale would be effected on June 28, 2007. Plaintiff remitted, via overnight delivery, the signed agreement, under protest, together with a cashier’s check in the amount of $10,000.00. During the negotiations to bring his loan current, plaintiff advised Chase that he was expecting the escrow on one of his rental properties to close momentarily and initially requested that the arrearage be added to the end of the loan. Chase declined that option. Plaintiff was also arranging for financing to take Chase off the loan and so advised Chase. Chase’s representative indicated that this was not necessary, that Chase "will work with you." Plaintiff’s escrow closed and he informed Chase that he would remit the $20,702.27 to bring the loan out of foreclosure. The representative advised that this would not be necessary, that $10,000.00 would be sufficient and he should keep the extra money as a "back up." Plaintiff worried about the sale date and wanted to pre-pay two months’ payment and again was advised this was not necessary, not to worry, Chase will work with you. In the process of the negotiations, the Chase representative had been informed that plaintiff had suffered a stroke in mid-February and was left recovering from physical and memory partial impairment, and a provision in the forbearance agreement covering illness or hospitalization was discussed with Chase. Plaintiff questioned whether he would get notice if there was any problem and the Chase representative assured him with "of course." This forbearance agreement transmitted one day prior to due date contained conditions not discussed with plaintiff and did not include provisions discussed. There was absolutely no communication, notice, or statement from Chase whatsoever and, due to the sudden illness and death of his friend and co-occupant of the home during July and August, plaintiff missed his very first payment under the agreement. On September 10, 2007, Chase’s representative executed a Trustee’s Deed upon Sale and on September 12, 2007 caused an Agreement to Vacate to be posted on the property. Plaintiff immediately contacted Chase and was referred to Chase’s loss mitigation department. On September 28, 2007, plaintiff requested that Chase allow him to bring his loan current by remitting the August, September and October payments. On October 10, 2007, proof of plaintiff’s ability to pay was transmitted to Chase based on Chase’s advice that, based on his situation, it is inclined to reverse the foreclosure and reinstate his loan. On or before November 4, 2007, plaintiff was advised that the file has been transferred to Chase’s Modification Department. All requested information, including banking information, tax returns and a hardship letter, and proof of insurance on the property requested by Chase, were transmitted to the Modification Department. Plaintiff dealt with the Modification Department until early March, 2008, when he was referred back to Loss Mitigation. Communication with Loss Mitigation commenced again on March 10, 2008 and on or about April 3, 2008, Loss Mitigation advised that plaintiff’s only option was to buy out the loan and transferred plaintiff to Chase’s REO Department. In response to plaintiff’s advice to Chase REO on April 3, 2008, that Chase Loss Mitigation agreed to let plaintiff buy out the loan, Donna Hopkins of REO referred plaintiff to "our (Chase’s) attorney’s office," and he had been "brought up to speed." Since they didn't want to talk to me anymore I got the VA Rep involved (we're military). They spoke with him only for a few phone calls and emails. The employees at Chase are not the brighest crayons in the box LOL. When the VA rep contacted the person that was helping me. He told the VA Rep tht he didn't put me on payment plan (even thought Chase was at fault). The VA Rep contacted me and told me what was said. I told him I guess he forgot that he FedEx the contract to me with all his information on it. The VA Rep asked me to fax a copy to him. So I faxed him a copy. He called me back a few days later and said he called and confronted the rep from Chase and ask him why he lied about the contract. He told him that he had a copy of the contract after that no more contact from him or his supervisor. Until this day the Chase rep will not speak to me or the VA Rep. That is okay because I have what I need to go after him & Chase. Our mortgage is always current until my husband deployed to Iraq three times. After Chase find our that he's deployed the next month the mortgage is messed up. When I called to find out what is going on and they tells me that my name is not on the mortgage and they can't discuss it with me. My name has been on this mortgage since we had the house built. I cannot believe all of these stories. At least we know that we are not the only people going through this. Here is our story. As of March of this year, I have been off work and on disability due to an accident that I got into ten years ago that came back to haunt me. Due to this I am now permanently disabled which means I am now on a fixed income. As of April of this year, my fiancé was laid off from his job. Therefore, he is now on unemployment, which means we were/are definitely in need of some help. I pulled up the Chase website and saw the modification that they offer. I called them, filled out ALL of the necessary paperwork, and submitted everything and I also called to confirm receipt. In addition, when speaking to the modification department we were told that in order to qualify for the modification department you MUST be behind in payments, so they told us NOT to make our July 2009 payment and all after until the modification is complete. They stated that ALL unpaid payments would be included in the new loan. This was all done by July of this year. They said to give them 4 to 6 six weeks due to all of the people applying for the program. I called about every two weeks and spoke to the modification department AND the collections department. We received at a minimum 3 phone calls a day from the collection department. I would tell them exactly the same story. I would even ask for the manager to make sure the correct person was noting it. I would ALWAYS get the same story from the modification department. They told me to ignore the collection calls and not to worry. They would also say that our loan is still being processed and to NOT worry about being foreclosed on. Since we had applied for the modification there was NO way our house would foreclose do the modification was in process. Well, on September 28th of this year we received an Acceleration Warning (Notice of Intent to Foreclose) letter in the mail and a certified copy as well. My heart sank. I called the modification department immediately. I was transferred to two people then I finally got a hold of a gentlemen who told me to disregard the notice. He said the same story; we cannot be foreclosed on while we are in the process of a modification. I asked him for an update on our modification and he said our loan is now with the collections department so I need to check with them. I called and spoke to a gentlemen in the collections department. He said our loan is with the modification department and did not know why the other person stated that it was with them. UGH!!! I asked him to transfer me to back to the modification department. He said it was now closed. Therefore, I started to ask him some questions to see if he could help. He said that he does see that we applied for the modification back in July however; he does not see that our loan has been approved or that it is pending. He said that it looks to him that NOTHING has been done with our application so far. He did say that the modification department is behind and that as of October of this year we will be four months behind, which means they could start a foreclosure. He also stated that since the modification department is behind he has seen some people lose their homes. I was extremely upset after that phone call. I pulled up the Chase website again and started to search and see if there was anyone else I could contact or anything else I could do. I found on the website that they had a local office for the modification department. I immediately contacted them and told them my situation. The person that I spoke to told me that even though we have applied for the modification, we could still be foreclosed on. She said we needed to make an appointment immediately to see one of their representatives so we can try to get this done. She also stated that when she pulled up our loan she saw that NOTHING has been done and there are NO notes for all of the times I have called and spoke to someone. Unbelievable!!!! Therefore, we made an appointment with a representative. We had to bring all of the paperwork that we had submitted back in July plus all of our current information. When we met with the representative, he said the same thing as well, that nothing has been done with our application and there are no notes on file. He told us not to worry and that he will submit everything and try to get everything done as soon as possible. He told us that if we receive foreclosure notices to fax them to him and we will postpone it and let them know that we are in process of a modification. He said that he will keep us posted every step of the way. He too said that he has seen and heard of people losing their homes because of all of the errors of the modification. He said it is so messed up that he does not even know where to begin. Well on October 26th we received a letter in the mail and a certified copy as well from Northwest Trustee Services, Inc. stating that they have been retained to initiate foreclosure proceedings on us. I immediately contacted our representative and left him a message. I also emailed him and faxed him a copy of the notices. He left me a message stating that he could try to postpone the foreclosure and that he has still not received a conformation on our loan yet. I immediately called him back and of course got his voicemail again. I also emailed him stating that yes, please postpone the foreclosure and that I would like a copy of his request and a copy of the confirmation for my records. I also told him that I would like him to find out the status of our loan and when we should have this all done. Well that was on Friday, October 30th. As of today, November 2nd we have NOT gotten an answer from him. My fiancé had to leave him a voicemail stating that if we do not hear back from him we will have to contact an attorney because we are still in the same situation that we have been in since July. This is ridiculous and we are so sick and tired of this. We want a resolution to this matter. There is no way that we can come up with this HUGE lump sum due to our fixed/limited income and we do not want to lose our home. In addition, our credit is currently all messed up due to late fees and negative reporting from Chase Home Mortgage. It is not fair that we have to suffer due to the incorrect information and lack of from Chase. We have paid on our house for almost 10 years and WaMu was the paperholder. Chase bought the loan and I had lost a job. They were going to help us with a modification and it has now been 9 months and we are now told that we are denied due to our equity being to high on our house. We too have sent paperwork in like so many times I hate to look. They always seem to be missing the same thing we sent before. We have kept all out paperwork, phonecall logs, people we talked to, and dates in a file that has to be 3/4 of an inch by now. He was in Chapter 13 in 2005 he was doing great for four years. But one day in Sept 2008 his lawyer called and said Chase says two payments are missing but not back to back months. So we said we have the soft copies of the checks but dont have prove they got them. So I said what can we do to fix this the money is in the bank account. So Oct 6 2008 we did a conference call with Chase's lawyers in Philly with my hubbys Chapter 13 lawyer and they said "Yes you can fix this send us three months payments in a cashier check and everything will be fine. Guess what we got it in writing send them the money and they would not cash those cashier checks.Now after all this a year later they have tried to foreclose 4 times right now we have a stayed on our home, but chase is still playing games with us. The chapter 13 lawyer stop my hubbys 13 in March 2009. The reason is to try to remodfied his loan. But if chase does not help him back into 13 he will go and they woun't get the house. I found out later that they had done nothing and my mortgage was then 3 months late (because all of the payments were being put into this escrow account). Chase also purchased my loan from New Century. I lost my house last year due to Chase Home Finance not responding to my many attempts (over an eight month period) to short sell my house to a cash buyer. In the end Chase sold my house to an individual buyer for $39,000 less than what my cash buyer offered them. I don't understand how a company, like Chase, can receive $25 billion from the recent "bail-out" then turn around and be non-responsive to homeowners. I wish our Congress, Senate, someone could answer why there is no check and balance in place prior to releasing such large sums of money to these large banks?
I find it amazing going through the experience I have the last year that Chase is able to use the "bail-out" money towards purchasing other banks. No notations on your account from the previous person you spoke with. NONE. You have to start all over from scratch. Chase Home Finance is the absolute worst company I have ever dealt with. Worse than Comcast, the previous title-holder. Chase owes me $875 in attorney's "fees and costs," which they agreed to credit to my account FOUR MONTHS ago and still haven't. We did a short sale in 2007. When I called Chase prior to see if there was anything they could do to refinance to help with the payments they said only if we were behind on our payments. My husband and I both lost our jobs in the same year about 4 months apart from each other. Amongst other family problems, I began the workout process with our original mortgage company. I was awaiting the final papers from First Place Bank when I receive a letter that my mortgage was sold to JP Morgan Chase. I spent months arguing with Chase that there had to be some type of assistance for my situation. They kept telling the that they dont reduce monthly payments. I understand that but dont you offer some type of assistance. After 8 months of arguing and attemping to contact every government agency to prevent foreclosure, I received foreclosure paperwork. When I say every agency, I mean every agency: Hope Now, Consumer Credit Counseling, NHS of Greater Cleveland, other mortgage companies, my former mortgage company, just to name a few. I found out that Chase did have programs to help with my specific situation...why am I being discrimanated against? I have no choice but to hire an attorney and a loss mitigation specialist who proceed to call Chase on a daily basis and threaten legal action if they dont help me. I cant be discriminated against if I have the qualifying events that they list. They have helped others with the same circumstances. So in the 11th hour, Chase finally send the paperwork for the option they chose for me. I didnt even get to negotiate anything. But what do you do when your house has an auction date and your 4 year old will have no home. So here we are 6 months later, I have yet to receive anything from Chase that they are receiving my payments and actually applying them to my account. They REFUSE to send me a mortgage statement. Everytime I call they tell me to call the person Bryan who has been assigned to my case. Guess what he never calls back. No one will give me information regarding my mortgage. So based on some legal advice, I withheld my Nov. payment. NO ONE EVEN CALLED ME TO SEE WHY I NEVER MADE MY PAYMENT. So I did the same with Dec. STILL NO CALLS. My online account states that I haven't made a payment since August. WHERE IS ALL MY MONEY GOING? Today, my only mission was to get information about my loan. I was hung up on, transferred to a fax machine, told that i needed to call the phantom Bryan, and told that no information was going to be given out. Now I sit in tears, I call back and finally speak to someone who has a heart. She tells me that my payments are making it to my mortgage but she cant explain anything else to me. She can get fired for giving me just that small piece of information. What the hell is that about...its my mortgage? They're servicing of my loan is PATHETIC and cruel. They messed up last year by not making an insurance payment for me out of escrow. So, the insurance company cancelled my policy! When I finally got Chase to recognize and admit to the mistake, they CHARGED me 136.00 for one day of insurance coverage until my former policy could be reinstated by Foremost. I could not believe that they made ME pay for their error. I could not believe that a bank frigged up a payment out of escrow. Also, my house's value dropped but somehow the tax escrow goes up...my payment went from 900.00 to 1230.00 for a revised escrow one month. I sent a letter asking to spread the escrow shortage over 36 months, but even though they approved that...guess what? They made me pay the first payment due of 1233!!!!! I could NOT make that payment and have since fallen behind. Does it surprise anyone here to know that this is A FIXED MORTGAGE NOT an adjustable yet I was put through what adjustable rates do to people because of Chase's ineptitude. This past month I was told on the phone by chase that my house payment had gone up $138.00 a month!! Did I get a notification of this - NO! Then I was told that my house payment was late!! UGH!!
