I am warning everyone to not do business with Chase Home Mortgage. In April 2006, they "lost" a mortgage payment and continued to show it past due. After multiple attempts to get the problem resolved (I have cancelled checks) I hired an attorney who sent a demand letter requesting an accounting of payments. They responded with a form letter that said they were looking into my issue. They never sent anything to my attorney, so she began calling. They transferred her to many people, none of whom were any help, and the 5th person actually refused to speak to her and disconnected the call. My attorney called back and asked to speak to a supervisor and to file a corporate complaint. We were finallly given an explaination that they did cash the check in April 2006, but they did not apply it because the payment was short, and even though they cashed the check, they waited to apply it until the following month, and continued to accept the checks that were sent in the same amount. The statements sent only had an amount due with no explaination of the charges. This continued for a year, and in February 2007 they showed another payment missed. During this time, my credit has been perfect, except for the Chase loan. They now show the payments two months past due, with no explanation except that the payment went up. I was never notified the payment increased, and even if it did, the amount of different would not add up to the amount past due they show the loan to be. They did not respond to my attorney's request for an accounting of payments that was made in writing by certified mail, or to a supervisor who took the complaint. I was notified the loan was now being serviced by Litton Servicing, but Chase continued to harrass me for late payments and threaten foreclosure, even though they no longer serviced the loan. I am complaining to the attorney general of Texas, the President of Chase Mortgage, and the FTC for violations of the Federal Fair Debt Collections Practices Act. They have also violated a section of RESPA. I am now being sent mail to another address where I formerly lived from agencies that bail out foreclosed loans saying courthouse records indicate the loan was foreclosed in Dallas County. Now my credit is damaged and I am paying the default rate for credit cards that I have never been late on due to my credit report showing the Chase loan past due. To make matters worse, a credit card I have issued through my employer, a large bank, has also raised my interest rate to 26.99% and my reputation with my employer is damaged. I am filing a lawsuit for predatory lending practices, and DTPA violations among other issues. Beware of Chase Mortgage!!

Why cant we file a class action suit against these pirates? They lie and stall adding late then legal fees. No one tells the truth or sends you paperwork you request. They never have the answer to What is the TOTAL - whatever you say you can pay they double it as the only acceptable, then when you are in foreclosure (all this starts with a forced placed insurance policy for the PRECEEDING year) then they keep calling but dont want to come to an agreement. Just keep those legal/late/whatever fees adding up. They need to be taught a lesson in the form of BIG BUCKS - the ones they have stolen from the consumers.


My court date is the 8th and I have NO legal council. ARGH!!!!!
