COMPLAIN AGAINST SHOPPERS STOP TO SHOPPERS STOP
SIR,
On March 11, 2007, I along with my wife went to Shoppers’ Stop located at 10/3, Lala Lajpat Rai Sarani, (ELGIN ROAD), Kolkata within the premises of the market “FORUM”. It is pertinent to mention here that my wife is a First Citizen card holder, Silver Edge, being no.2210911500081328.
One of the salesman namely Mr. Rajesh Jha misbehaved with my wife and upon complaining the same the said Mr. Rajesh Jha got annoyed and insulted and/or argued with my wife in presence of many customers and other sales man of the outlet which by innuendo meant and were understood to mean that my wife was misrepresenting the act of the said salesman. I instantly called the manager of the outlet Mr. Kanishka Banerjee who without hearing the matter supported the said salesman and refused to entertain any grievance and further insulted and vilified me, which was not expected from a Manager of a store of your repute and esteem.
Mr. Kanishka Banerjee and/or other staff of the outlet and each of them contrived and the acts were intended to injure and disparge my reputation and goodwill. Under embarrassing situation, I had to return from the said outlet.
There exists no standard to ascertain the damage caused by such act of the salesman and the manager and no monetary compensation could provide adequate relief.
The act of the salesman was contrary to all rules and the same was also violative of principles of legitimate expectations and suffers from the vice of Wednesbury unreasonableness and amounts to malice in law.
It is a settled law that the Principal (in this case SHOPPERS’ STOP) is liable and responsible for the acts and omissions of its agents (in this case employees of SHOPPERS’ STOP, Mr. Rajesh Jha and Mr. Kanishka Banerjee).
I know that any explanation on the part of SHOPPERS’ STOP will not mitigate my feelings of disappointment given my experience. However, I hope you will introspect your steps and improve your service levels more than anything else.
