Joe Nastasi dba The Tub Factory I am adding my complaint to the others that have been lodged against this sleazy operation. I spent $6800 for a jacuzzi bathtub, installed by The Tub Factory in Melville, and warrantied for 10 years. After 3 1/2 years, it sprang 5 huge stress fracture cracks (one as long as 31 1/2") radiating out from the jets. My downstairs bath was flooded and the ceiling ruined. It was apparent that the tub was defective and could not be repaired enough to hold the weight of 90 gallons of water, the tub capacity. After 37 phone calls, 3 no show appointments and a repair job which was unsightly and unsuccessful (it looked like toothpaste had been squeezed into the cracks!), the tub leaked the first time it was filled with water. Again my downstairs ceiling was ruined. The technician told Nastasi that the cracks were too large to repair -but he ordered him to do it anyway -thus causing more flooding and damage to my home. I was charged for this repair. They did not respond to the Better Business Bureau; the County said that they were not licensed to do home improvements, my last resort was to take them to small claims court. I have not had a functioning bathtub for 15 months while I tried to resolve this situation. Today in court, Nastasi entered for his defense that he had sold me an 8 year old, scratched and chipped floor sample as is and that it is not warrantied for anything! I hope the judge did not think that I was stupid enough to purchase something like that with no warranty. He also lied and said that the tub was filthy, poorly maintained, etc. Fortunately, I realized what scum I was dealing with and had pictures of the tub and bathroom showing them working on an immaculately clean tub. I have no idea what the arbitrator will rule on this ...but I hope common sense and my documentation will prevail. If I am granted a judgment against him, I know that he will default and I will have to go through the Sheriff's office to collect. Whatever the outcome, I will pursue this matter to the ultimate. Unscrupulous businesses like The Tub Factory should not be permitted to prey on new consumers. Do your research! This Joe Nastasi opens a new business and changes names to avoid legal action. He is a real con artist -but a stupid one- who does not keep records because he is probably scamming the IRS. Avoid dealing with him at any cost. If you already have a product from one of his stores-be sure to cover yourself by getting a specific, personal written guarantee. Hopefully my case will hold water better than the Tub Factory tub!
