RE: Affinity Federal Credit Union Loan No: 143 Assistance to prevent the unlawful Repossession of my vehicle: 2000 Toyota Camry Dear Representative My name is Ms. Monica Pinckney and I am writing to you regarding an urgent matter. My matter is regarding Affinity Federal Credit Union. I initially purchased my 2000 Toyota Camry for $21,842.00 & financed it for 5 years with Toyota Financial Service. I refinanced the car with affinity for four years for $18,192.88 my monthly payments were at first $450.00 with an APR of 7.9%. Eventually, I got the APR down to 6.4% and my payments went down to $350.00 then $311.00 per month. My problem with Affinity is they repeatedly sent past due notices on my account, which was incorrect. I was sent past due notices, requesting additional payments for sometimes-double payments on the account. I knew logically that there is no way the account could be late on any car payment. My account was set up for direct deposit each month, since the day the account was opened for almost ten years now. I have always had my paycheck direct deposited into the account and set it up for automatic deduction of car payments. Affinity repeatedly received numerous payments on the account. I repeatedly requested the account to be researched, investigated and also to stop the payments. The Financial Recovery Consultants informed me, that my account could not stop the payments without raising the balance on the account by several thousand dollars. I also repeatedly requested to speak with a manager I was refused & denied. I often would be transferred to other consultants who lied and said they were managers & supervisors. In any event, I got nowhere and this billing issue carried on for years. I moved of state for the better part of the last 2-3 years, so often I made numerous payments through Western Union. Many times while I was out of state my affairs we handled by other members of my family, until I returned to New Jersey in 2005.
Monica Pinckney page 2 My main point for writing this letter is to inform you; that from the years 2003 to current date: 1) The consultants placed unnecessary holds on my account, which froze my account and billed $25.00 NSF Fees (which cost as much as $200.00 in one month) when the money was direct deposited free & clear each month. Also, As of 8/2005 I became permanently disabled & a US Treasury Social Security Check is deposited each month. The customer service representatives & Financial Recovery Consultants still - refused to credit the account. I live off of the account and use this money to pay bills & so forth. Each time I attempted to use the card, even before checking prior to use, I would fine a hold on the account and another NSF Fee. 2) The Financial Recovery Consultant named Steve billed me $25.00 after every third transaction, he stated that it is the law and part of the new financial guidelines issued by the Bush Administration. I still never received credit for that. 3) I was billed 1/16/2006 $593.00 for auto insurance for the year 2006, 1/5/05 $963.00 for the year 2005 & $1,192.00 for the year 2004. These costs were added to the balance of the loan. Affinity states the additional amounts paid on the account were for the insurance. I've researched & did the math, none of the charges explains or computes correctly to match the reason for the over charges through out the year... 4) I was double & triple billed which you will see on the attached invoice. (The amount to be paid per month is $311.76 per month.) 5) I was never initially sent the car insurance declaration & break down of coverage, none of Affinities statements indicate exactly what the monthly break down of payment is and they never furnished documents upon request. I had to contact the secondary insurance company & finagle my way, into obtaining any information. The insurance company stated, I was not entitled to it and I had to request it from Affinity. 6) Reporting incorrect data to Check Systems. Example no. one: On the May 2006 invoice you will see two payments for $180.99 totaling $361.98 and the principal taken out of payment was $24.45 & $22.05 total paid to principal is $46.50. (This is outrageous on a loan with an APR of 6.4%). Basically, Affinity is reversing APR & % rates by billing me a higher rate every other month then lowering and raising the principal (APR & daily rate). The result is the constant reversal of the principal, which appears to gradually fluctuate. The fluctuation results in the principal absorbing most of the payment; thus the amount paid on the loan would be very little. This way of reversal of APR & % would cause the balance of the loan to not reflect the full payment. Example no. two: Please view invoice dated February 2006, I paid $361.98 on 2/3/06 $58.81 went to the principal. I also paid $75.00 on 2/25/06 $ 21.96 went to the principal (total Amt. To Prin. $80.77). Only $356.21 was applied to the balance out of a total payment of $436.98.
Monica Pinckney page 3 7) The real proof of my case took place June 29, 2006. I received check no: 1004 dated: 6/16/06 drawn on Richmond County Savings Bank. I received this check & deposited the check into my account, which bounced. I was out of town when the check bounced. I spoke with Cindy Shaffer Financial Recovery Consultant; prior to making the transaction we were awaiting the check to clear. Cindy made roughly $260.00 available to me while I was out of town. Upon my return I learned the check bounced & was billed NSF fees. I again requested to speak with a manager. Again, I was denied, so I got in my car and drove from Bayonne, NJ (where I live) up to Basking Ridge, NJ where; again I was denied the right to speak with a manager. I was instructed account was 60 days late & to pay the car payment &, so I made two payments one of $542.11 & $180.99. I asked why, and was told that the added cost was because of the car insurance, which was added to loan balance. I said the insurance only cost $$593.00 for the year, which I am sure I already paid with all the extra payments. I was then informed that I was soon to be three months behind in my payments, so I should pay an addl. $650.00 to hold the account so my car would not get repossessed. I was also informed, that I had to repay Affinity the $1000.00 for check no: 1004 because Richmond County Savings Bank paid it and Affinity covered the check. I received a letter 6/29/06 which you will find in the attached documents where Gillian Pinter an Affinity Fraud Investigator & Recovery Administrator requested me to pay $1,018.32 to cover the check. I then made and attempt to re-pay the $1,000.00. I struggled & re-paid $800.00. In addition, I decided to research the banking records of the person who wrote me the NSF check no: 1004. I found that Richmond County Savings bank never paid the $1000.00. Therefore why was Affinity requesting me to repay a check, which was never paid by Richmond County? Affinity went so far as to report the bogus transaction to Check Systems, which has now prevented me from opening any other bank accounts. Affinity has even wrongfully closed both my savings & checking account. (You will also find the copy of the Richmond County Savings Bank Statement, which proves my case.) I immediately sought legal advice. 8) In January 2007, I brought an excel spreadsheet which I created that gives the simple break down of my Affinity account for the year 2006; along with the supporting documents previously listed. I had the spreadsheet reviewed by an accountant, a Financial examiner from another Federal Credit Union, an attorney and they all stated Affinity has over charged and blatantly taken advantage of their position as a Federal Credit Union and has stolen my money and most importantly broken my faith & trust in financial institutions. Finally, I received the opportunity to state my case and reveal my findings. On the day of meeting with Affinity they did not even have the correct entries listed in some of their reformatted copies of my statements. Some of their entries did not match my original statements, all payments were not listed, and important entry data was not even listed on most of their documents. Monica Pinckney page 4 Unfortunately despite my efforts, I got nowhere with Affinity. Basically the unfortunate outcome is that Affinity is now requesting another $3,558.52 or they will repossess my car. I am requesting a review of my documents and someone to call me back regarding this issue. I am a veteran and now I find myself disabled after my many years of working and paying my hard earned money for a car in the year 2000. I live off a meager means and I do not have the funds to continue this shame. I have suffered through all these years with Affinity. I know that no one pays for a car purchased in the year 2000 for seven years. I have a copy of my 2003 Equifax credit report and you will find that Affinity reported my balance on the car loan to be $11,224. I have researched and ran the numbers, only to find that Affinity needs to explain where the money went. I am seeking your urgent assistance in this matter, because sadly I have done all I can to appeal to Affinity. Now, I am utterly at their mercy - which based on my past & present experience seems to be merciless. I cannot afford to lose my car or even try to purchase another one if this one is wrongfully repossessed. I am collecting disability and there is no way I could ever afford to buy another vehicle. Any assistance in this matter would be greatly appreciated. Sincerely
