Consumer Complaint and any help you might offer We are a small Apple ipod repair and resale business. Recently, we purchased a salvage lot from Liquidation.com for $2,875.25 and were the victims of a bait and switch fraud. The auction title "26 Assorted Apple Ipods up to 80GB" Auction ID 1091878 from the seller techexcess. The manifest clearly stated ipod 5th generation videos (3 - 80Gb and 2 - 30GB) were included with 3rd and 4th generation ipods. The shipment arrived and all 5th generation ipod boxes contained older 4th generation ipods. The whole lot was composed of 3rd and 4th generation ipods. This is simliar to ordering a 2006 automobile and being sent a 1999-2002 model. The misrepresention represented a total of 20% of the lot. Liquidation.com allows for a 2% variance which we understand. We put in a dispute claim with Liquidation.com and after 10 days were told we would be refunded for 3 missing ipods 3 X $111. We then communicated our problem with this resolution that highly favored a prominent seller on the Liquidation.com site. Their response was "We are unable to change the dispute resolution as they are final. We hope we will be a better service to you in the future. Thank you." In the end we ended up paying a premium price ($106 each) for older 3rd & 4th generation salvage ipods that typically go for between $30-$55. No ipod seasoned ipod buyer would ever have bid this high without inclusion of the 5th generation video ipods. In fact another recent auction from techexcess composed of similar ipods of 3rd & 4th generation ipods to those shipped to us brought $53.33 per ipod. We also have documented many other examples of this pricing for such items. Lastly, we appealed to Paypal who the payment was made through and lost the dispute since they do not get involved in the attributes and quality of purchases. The quality was fine....it was salvage and we knew this......we just are sick at the "BAIT AND SWITCH" tactics used by techexcess and condoned by Liquidation.com through their one sided dispute resolution process. By the way we still haven't received the refund of $333 from Liquidation. com and they have denied access to our account. Any suggestions you have regarding this issue or comments would be highly appreciated. Thank you for the opportunity to say somthing about this.
