To Whom It May Concern:

 

My name is Shahaf Sasson I am the owner of worldwide Moving Systems, I am making a complaint against Bell South Directory Advertisement.

 

Kyla Russell a Sales rep for BellSouth was in our office in November 2005 to sell us a 1 year adds in the Yellow Book. I explained to her that we do not want to advertise in the yellow book & that we do not sign anything for a year & that advertisement in the yellow book is not something that is good for our company.

 

Kyla Russell then offered us to advertise in the Bellsouth Internet Directory also for a year contract. Again I explained to her that we do not sign long term contracts, we only go by a month to month contract system. Kyla then offered me that she may be able to set up a 6 moth contract for me at $621.00 per month a total of $3726.00 for the whole 6 months. I told her that I am will to give them a try for the 6 months.

 

Kyla went back to her office to get the okay to do the 6 month contract & faxed me 1 page to sign & fax back to her. On the Directory Order Summary (Which is the only thing I signed) It has the being date of 11/30/2005 & an end date of 04/30/2006 which is exactly 6 months.

 

We started our monthly advertisement on 11/30/2007 & also our payments started on the same date. And from my understanding of the signed Order form I have, the advertisement & Payments would stop 04/30/2007.

 

In May I was still receiving bills & the arguments have started back & forth, every time with a different customer service rep. It is now February of 2007 & I am still receiving bills & the arguments over this are still going on. We refuse to pay for something we did not agree on.

 

During the several conversations my partner & I have had with Bellsouth, Their story has changed so many times. At first they told us that they don’t have a 6 month contract with any of their customers & that all their contracts are 12 months contracts only.

If this is true our contract should have ended November of 2006.

 

We have requested many times a copy of their contract that will show us where it states a 12 month contract. The also told us that it states on the reverse side of the contract it states all this information. We have never received an actual Original contract we received 1 page out of a 3 page 2 sided contracts that we signed; we never initialed or signed anything else.

 

For some reason we were not able to get any of the customer service reps to send, e-mail or fax us a copy of the contract with both sides.

We have been getting the runaround for the past 8 months now & no one in customer service can give us a strait answer of how to solve this problem.

 

On January 31st 2007 I received a phone call from Jose Fernandez a customer service rep that was supposedly trying to help us. He said that he did all he could but unfortunately cannot help us or change anything he is not a manger & it is not his job. But a bout a month or so ago he came personally to our office claiming “to help us” but wanted us to agree to sign a 12 month contract to advertise in the yellow book. We refused nicely of course but will appreciate helping us to resolve this matter. So basically Jose came here to stall us & to try to sell us more advertisement to suit his own benefits.

 

On January 31st 2007 another customer service rep called me by the name Marie, She also told me that unfortunately there is nothing they can do. I asked her when does my contract end she kept repeating that she cannot help me. Then I asked her if it is a 1 year contract she said yes then I asked her then it should have ended in November. Marie then changed her story again and said that we signed for a 18 month contract, I asked her to send me something that shows that but she said she doesn’t have anything & she cant help me.

 

On January 31st 2007 I called customer service and got Bill on line from the Georgia location. I asked him if I can fax him the form that we signed to him so we can go over it together & maybe he can explain to me what is going on. He agreed & gave me a fax number & told me he will call me back when he gets the fax. Bill called me back after he received the fax.

We went over all the information, & I explained the situation from the beginning. I signed on 11/29/2005 & Kyla & I went over the form & the dates. She showed & told me that on the form my last date for changes is on 11/30/2007 & also when my advertisement & billing will start. She also showed me where & when my contract ends which states 04/30/2005, exactly 6 months as Kyla & I agreed on. I wasn’t happy with a 6 month contract & I also told Kyla that I work with all my other Internet advertisement on a Month to Month contract. Such as: Movers.com, Vanlines.com etc…

 

I understood, & I sign contracts & do advertising for 5 years now, that I was signing with Kyla a contract for 6 months only at $621.00 per month a total of $3726.00 for the whole period. I agreed to this as a trial to se if it worked or if it is economical for my business or not.

 

 

 

After explaining all this to Bill he claimed that the contract I signed for was an 18th month contract which came to a total of $11,178.00 for the whole period. That is 3 times as much as what I agreed on. After explaining to me what he sees in his computer or on his file I Asked him to explain to me where on my signed contract/form it says 18 months or if he can send me a copy of this so I can see and read it. I also asked Bill what does it mean then on my contract 4/30/2006 Where above it says Estimated Bill date. Bill claims that that is an automatic date that shows up on a contract & that date is when my Yellow book advertisement starts. I asked him okay then where is my yellow book advertisement? He stated that I don’t have one. So no matter what I asked he had an answer but it never made any sense, and he was not able to provide me proof of an 18 month contract. I told Bill that I think Kyla Russell put that date there to deceive me into signing with her.

 

Bill kept insisting that the date 4/30/2006 is an automatic date that appears on the contract, I understood that I am just hitting a brick wall & I am getting no where with all the conversations I have had with Bell south. I find it hard to believe that their customers sign a contract for a year with an end date showing or having something stating it is for a 12 month contract. I also find it hard to believe that they cannot provide me with documentation or proof to this signed contract I have with Bellsouth. If I have a date that says I should have an add in the Yellow Book, Where is my add?

 

When I told Bill I will have to take legal actions & send this to my attorney He said that its fine & it states on the contract: “Liability for Errors and/or Omissions is Limited”.

 

That was the last conversation I had with Bellsouth. I noticed also after I hung up, that on the form that I signed up for: Ft. Lauderdale Internet advertisement, There is no beginning or end date just the monthly price I am supposed to pay. There are only dates for the Yellow Book & Companion. So what does that mean?

 

 

I am ending my story here, hoping that others will not be scammed & make the same mistake I did by advertising with Bellsouth. I am sending this to:

Consumers beware...if you are having problems with your line and you call in to have it checked and you don't have their "service plan, " then pay attention. Bellsouth/at&t will automatically charge you ~$90 if "they determine" that your problem is inside your home, without prior notification or further investigation. They use to come out and determine if the problem was theirs or yours and give you the option to have them fix any internal wiring for a fee/rate, but now they must be desperate for money.
