I am writing to tell you of their merchant friendly but not so consumer friendly policy.

 

I was solicited by phone to order some weight loss meds which I had a prescription for once a couple of years ago. Having gained 10 pounds since a hip replacement surgery stopped me from the vigorous exercise it takes to keep me in shape, I decided that what worked before should work again.

 

The telemarketer took my visa number and promised me delivery in 2 business days. The appointed date arrived and no delivery was made. I went to the Bank of America online website and checked my account to see that the amount of purchase was marked as TEMP charge , meaning that it hadn't yet been charged to my account, and I assume the product was not yet forthcoming.

 

I am a bit leary about telemarketers, and even moreso about those that don't follow through with what they promise, but because I was traveling the rest of the week I felt that the product might show up while I was gone and create a new set of complications.

 

I called Bamk of america and told them that the telemarketer didn't follow through as promised and that I would like the TEMP charge removed, and the sale stopped. I was told that BOA would not do that, but that when the product did arrive and the charge went through I could then dispute the charge.

 

This seems ridiculous for a couple of reasons. First, the telemarketer made a promise to deliver on a certain day, but then did not, thus breaking their contract with me. This should , in my opinion, void our agreement. So what is the purpose of disputing the charge after the promise has been fullfilled? I think BOA, wants me to accept the late product and forgive the merchant for their little white lie, thus increasing their own profits. It would be even more ridiculous for me to call BOA customer Service after the fact, and tell them that I had indeed been delivered the promised product, but that I was disputing the claim because said product was late. I think if I refused the product chances are, I would probably have to pay for (overnight ) shipping, although I am not sure about that.

 

My conclusion here is that merchant friendly Bank of America cares more about the merchant making sales than they do about the consumer getting what is promised to them.

 

I will dump the Bank of America visa card at the first oppurtunity.
