Movie Gallery Video Rental Movie Gallery - Avon, NY

Several weeks ago my wife and children had rented two children's movies from Movie Gallery in Avon, NY. This past Saturday I rented another movie and was notified at that time that the movies rented previously were still outstanding. Upon returning home we searched the house and found the movies. During the time that had elapsed between renting the movies and my return to the video store we had not received any notification from Movie Gallery that these movies were late, either by phone or mail. We truly believed at that time that we had returned them.
I promptly returned to the Avon store the next day with the movies and met with the clerk on duty at that time. I explained what had happened and asked if given the amount of time that had elapsed, if I could purchase the movies instead. She replied that I could, came back to me with a price ($27) which I paid and then I left with the movies. At that point I believed this whole matter settled.
The following day the store manager called to inform me that the clerk had no right to sell me the movies and that the amount I had paid only covered the past due rental fees. I explained to her that the whole reason I offered to purchase the movies was to do so in lieu of the rental fees. This is basically the same program that Blockbuster offers so it is not anything unusual. She became extremely rude at that point and took the position that according to the computer I was still renting the movies. I let her know that as far as I am concerned I bought the movies and would not be returning them.
I am astounded that Movie Gallery would treat a loyal customer in this manner. We have been renting movies from this store since they opened over 3 years ago. I estimate we have spent well over $1,000 on various movie and video game rentals during that time. I sent a letter to Jeffrey Stubbs, the Chief Operating Officer at Movie Gallery regarding this matter but have not received a response as of today. I have however received an invoice from Movie Gallery for $55.13 for these movies which I intend to dispute and will not pay. Unless this matter is resolved to my satisfaction we will definitely avoid any future business with this company. One of their Employees sold you those movies on their behalf therefore you are in the clear..threaten to get a Lawyer and take them to court and sue them for harassment..you can get more from them then they can get from you, but you need the receipt..if they ask for the receipt make a copy and send it to them or take it to them..whatever you do don't give them the original!! If you didn't get a receipt or you threw it away or lost it then you are screwed!
