COMPLAINT: STATE OF INDIANA - I.N.D.O.T. - INDIANA DEPARTMENT OF TRANSPORTATION:

In 2003, I.N.D.O.T. was contracted (???) by a private resident who lived on the corner of the highway to remove highway water from storms. WE WERE NEVER WARNED THAT WE WERE GOING TO BE USED TO HOST STORM WATER SO THAT WE COULD STOP OR PROTECT OUR PROPERTY. Our town of Napoleon does not have a storm drain system and I.N.D.O.T. was well aware of this. They placed 18" pipe and ditches around this ONE resident's property, and the THEY CAME IN with by placing more PIPE and a DITCH along A PRIVATE TOWN ROAD 220' AND DROPPED ALL THE HIGHWAY STORM RUN OFF AND ALL THE GARBAGE FROM THE HIGHWAY INTO MY UNPROTECTED BACK YARD. We get flooded almost everytime it rains. The State of Indiana has bankrupt my family trying to fight this in litagation. WE CAN NOT AFFORD to fight anymore!!! We get flooded from 2' x 20' wide with water flowing so fast that it would knock down anyone! I.N.D.O.T. lied on their LEGAL RESPONSES, on paper and states that the ditch was there, when we have pictures of the state digging and doing this work. I.N.D.O.T. attorneys FAILED to show up for depositions without any chance to RESCHEDULE. I have had to clean up disgusting garbage, oil, metal, debris for years everytime it rains, the HEALTH DEPARTMENT refuses to take ANYMORE reports. I HAVE BEEN CUT & INJURED SEVERAL TIMES FROM METAL, CANS, AND SHARP ITEMS!!! These had to be cleaned up because of our children. OUR HOME HAS BEEN AND IS TREATENED AND IN JEOPARDY FROM WATER for years!! MY LIFE IS IN DISTRESS EVERYTIME IT RAINS AND AFTERWARD. We have children and they are growing up with this mess. LEARNING HATE FROM THEIR OWN STATE!!! Kids tease them at school, about the river through their yard. The TOWN won't help at all, they allowed I.N.D.O.T. to do this because the resident is related to a TOWN BOARD MEMBER. We placed sandbags to slow the water down and the town took them. We put a screen to control the garbage and debris and the town took that, too!! The residental house was the ONLY house that I.N.D.O.T. did this FOR!!! THE STATE IS USING THE TOWN TO HOST STORM WATER FROM HIGHWAY TO HIGHWAY INSTEAD OF PROPERLY FIXING THE PROBLEM!!! We can not get flood insurance because we are not in a flood zone. FEMA won't help!!! Our land has eroded and they are stealing 1/4 of our property!!! NOBODY WILL HELP!!! Our ELECTED officials in the STATE OFFICES won't help!!! Local news have not called me back all these years. WE CAN NOT MOVE BECAUSE NO ONE WOULD BUY OUR PROPERTY and the town threatened to SUE us if we stopped the water.

MY POINT: LET PEOPLE KNOW THAT THE STATE OF INDIANA CAN DO THIS TO ANYONE!!! I DON'T LIVE ON THE HIGHWAY, I LIVE A BLOCK AWAY!!!
