central kia of lewisville On the 4th of January, 2007, my husband and I decided to buy a new car at Central Kia of Lewisville, Texas. I wanted to use my 2002 Saturn SL1 as a trade. I owed a little more than $3,500 on it and they were advertising a $3,000 on your trade, minimum. Our credit was not the best and a Kia was our best option of approval without a down payment.
When we arrived we were only shown 1 car, the Spectra 5, because they said that it was the only car we could be approved on. We were told that the payments would be nearly $100 less without the trade because they were charging us fees for the trade, but we could not afford to carry both notes, which is something that they knew. I would have walked out then and there (20/20 hindsight says I should have followed my gut), but my old car was unreliable and it was the only one we had. We signed on the dotted line and traded the car.
Less than two weeks later I get a call from the sales associate asking about the VIN. He wanted me to read it off the vehicle to him and he said we needed to stop by the dealership because they got the payment wrong. My husband had the car, so when he got off of work we took it to the dealership. When we got there we resigned the paperwork for the first time and the payment was lowered by a few dollars a month.
A couple of weeks later the collection calls started for the Saturn SL1. I explained to the people that I traded in the vehicle and that the car company should be sending in the pay-off amount. I then got a call from the Kia dealership. They got the VIN wrong on the vehicle and we needed to resign the paperwork again. Time number two.
When we arrived, I asked about the pay-off on the other car and was told that as soon as this deal was resigned that the check would be sent. I continued to get collection calls.
In March we get another call from the Kia dealership. Apparently they had another mistake on the paperwork. They had gotten the year wrong and we needed to resign the paperwork. Again. For the 3rd time. I asked about the pay-off of the other vehicle and they assured me that it would be sent.
Another two weeks goes by and I am still receiving collection calls. The paper tag on our car ran out-again- and we returned to the dealership. The finance director told me that he had been on conference calls to the other car's financer and that he had gotten everything straightened out. He said that the creditors had already cashed the check.
I called on 4/02/07 because the other financers had never been on a conference call and still did not have the check. They said that the car would be repossessed on April 5, 2007, but because I had traded it in it would only go on my credit and they would not have the car. I called every day this week, because I was told that if I had a check number, my credit would be safe. I was told twice that the check had been overnighted (two separate days) and the other company still has not received the payment. I called the Kia dealership and threatened a lawsuit and a theft report of the vehicle.
On 04/06/2007 I called one last time for the check number. After being shunted from person to person and being placed on hold for 20 minutes, a man claiming to be the sales manager told me that he had been instructed to inform me that they would no longer be accepting my calls due to my threats of a lawyer and that the next time I called, they would file harrassment charges against me.
All I wanted was my trade-in to be paid off like they had agreed in January. If I refuse to pay a debt, it goes on my credit and the vehicle would be repossessed. I guess they get a different set of rules.
