HSBC- LOAN ACCOUNT- EXCESS EMI

Hi,


My name is Nimisha Bali and I am a personal loan

customer with HSBC and have been really harassed by

them.


I need you to help me please and advise how to take

this forward.

I have a personal loan account with you-

105-388151-872


 


This is my final attempt in trying to resolve my

concern with HSBC, post this I am moving to the

consumer court any which way.


 


Here are a series of things that happened:


 


In August 2006 I took a loan from HSBC roughly for

about 3.5 lakhs


As a mode of EMI I signed the ECS facility document

with HSBC


October second week I get a call from your

department-collections stating that the ECS has not

gone through for September and October.


To my surprise I asked them why it had not got through

and nobody could give me a direct answer

Then one of your managers- Amar- HSBC branch Pune

called me and told me that I had taken a loan in Pune

and my bank account was in Noida and that could be the

probable cause of the ECS not going through


My answer to that was rather straight forward- why did

the person get the ECS document signed when there is a

clause like that- I am yet to get the right answer to

that- BUT I AM NOT AT FAULT


Then since I dint have any bank account in Pune as I

am on a Project there and all my bank accounts are in

Delhi- I had only 2 options i.e. make a cheque payment

every month and pay a fee of Rs 200 on that as its an

outstation cheque or pay in cash every month to the

collection agent.


I agreed to making the payment every month in cash

In December of 2006 I was traveling and therefore

couldn’t make the payment


On Jan 4th I made 2 payment one in cash for 9600/- to

be adjusted against the Dec payment and one by

cheque- 582677 dated 15th Jan ( HDFC bank, Noida) to

be adjusted against the Jan payment- as the ECS was

not getting through


In February of 2007 I realized that suddenly HSBC was

able to take out money via the ECS- I still have no

clue how you were able to do that- what changed?

March 17th I was leaving for Delhi and I got a call

from one of the collection agency- stating that I

should make a payment as my ECS had not gone through.

I told the lady that whenever I get the time I will- I

was mislead and misinformed


Around March 27th or so I went and made a cash payment

of 10,000/- against my March payment

Later I checked my bank account from where you have

the ECS facility that again the ECS had gone through

already and I was misinformed and that I had paid

twice in March


I called your customer service number and spoke to

some guy, and inquired can the excess money be

adjusted for the next month’s ECS, he said that is not

possible and it is advisable to get the refund, we

agreed that he would process a refund against the

excess amount paid


I then went back to Pune and only to realize that 2

weeks were over and I still had not received my

refund- and I misplaced the complaint number I got the

first time


I again called the customer service number and only to

find out that there were no records of my earlier

conversation with the rep before. I again lodged the

same complaint and this time I was told that – the

excess payment was adjusted against the December

payment. I inquired how is that possible as I have

already made the payment for Dec


Logically if you had not received any payment in Dec,

then any payment I made in Jan should’ve been adjusted

for that payment right? How can you adjust the payment

I made in March against Dec

For the last one week I have been trying to get to the

bottom of this problem and just been getting a run

around. My current complaint number is 2704499472.

 


This is my last attempt to bridge any relationships

with your company, If I am not given any direct

answers then I am moving to the consumer court in the

next 24- 48 hrs.


 


I am an unsatisfied and harassed customer. I am most

interested to go to any lengths to let the consumers

of all personal loans know that this is how HSBC

treats their customers once the loans is availed.

Therefore I will first approach the consumer court-

then do a stop payment if they advice the same and

then approach the media to air this complaint.


 


I just called and spoke to Mr.Banerjee on 044 - 4390

2035 and told him all this and on his request I am

writing to you. I will only wait for 24 hrs
