Last summer (2005), Mr. Benveniste came to my home and asked me if I would

allow his workpeople to come on to my property to run underground power

lines from the power pole in my backyard to the "McMansion" he built on an

adjoining property.

Being a longtime member of my community and a good neighbor, I told him that

he was welcome to dig the power line ditch across my property on the

condition that he repair the damage to the lawn and re-seed the area

affected before the following (2006) spring season. He specifically and

eagerly agreed to do so.

It is now May 2006, and the work has still not been completed. Mr.

Benveniste has refused to acknowledge my telephone calls or my e-mails (of

which I have a complete record if you need them). I was finally forced to

fill in the ditch myself and re-seed the affected area, and it still looks

patchy, muddy and awful. There is also a black power line sticking up out of

the ground, coiled in the mud, which could pose a safety hazard to my

children and my pets.

I feel that I was lied to and deceived, and that all Mr. Benveniste really

cared about all along was selling the adjacent property with no regard to

the neighbors and longtime residents that were already there. I have tried

to solve the problem in every amicable way I know and he has been

unresponsive and thoroughly unprofessional.

My next step this evening is to file formal complaints with the Better

Business Bureau, the state/local Board of Realtors and the National

Association of Realtors. I hold very little hope that Mr. Benveniste will

address (much less correct) this problem, but I feel the need to warn other

area residents what they may be getting themselves into when doing business

with this gentleman.
