Complaint against Ebay client and PAYPAL Honolulu, HI 96815-3991 May 24, 2006 RE: E-Bay customer and Paypal nightmare To whom it may concern: I have been having a major problem with a member of both E-Bay and Paypal. She ordered a set of $25.00-30.00 books from me, each brand new as I already had a copy and was given a second one as a gift, at which I sold to her new for a mere $7.00. With shipping and handling, the total came to $12.00 and I shipped it priority mail with delivery confirmation. The package was delayed at getting shipped because the item was in my car, which was in the repair shop at the time. Although I mailed it later than I normally would have, I wrote to the buyer, apologized and explained the delay and sent it by priority mail, and gave her a delivery confirmation number so that she may track the shipment, which also served as proof that I had indeed mailed it. Initially, the package was undeliverable due to unknown causes and the just prior to receiving the package, she filed a complaint against me for non-delivery of the item. Again, this is all over a $7.00 item, which she purchased at a real bargain. Since I received no responses to the explanation and apology of delay, I assumed all was well and she would be a nice and understanding client. The EBay transaction number was 7024182448 and the associated Paypal transaction number was 71838460SB679013N. She paid by Paypal on 04/24/2006 and I delivered it on 05/15/2006 with delivery confirmation number of 0306 0320 0000 1914 3196. For some unknown reason, an attempt at delivery was made in Miami on May 11, 2006 and was undeliverable. Then on May 15th, it was delivered to her St. Petersburg, Florida address but again undeliverable. About an hour later, on the same day, it was finally delivered successfully. At no time during any of these delays did the buyer ever ask me about the delay of the delivery or any problems that she had. Instead, she filed a compliant with PayPal which restricted my account so that future activities, including deposits from buyers on other items was prohibited, making it possible for me to upset additional clients. I contacted the buyer/plaintiff repeatedly without response. On 05/06/2006, the buyer/plainiff issued an additional payment to me as a financial gesture of apology with the following quoted message attached to the payment: Subject: Thanks so much Note: Hi Sandra, Thanks so much. Please accept this small token for the book. It wasn't your fault. I will definitely leave positive feedback ASAP. Shipping Address: L Menandro Abrenica (Email User) 11502 7th Lane North Unit # 1404 (EBay name “mama_is”) St. Petersburg, FL 33716 United States I never did receive that positive feedback nor did she ever respond to my personal emails, no matter how non-threatening and polite I was, despite my growing frustration. Within my email, I practically begged her to amend the situation with Paypal in order to restore my financial transactions. She never did so and never acknowledged my requests or emails. I then sent a refund of the original shipping and handling, not wanting to refund the entire amount without having the original items returned, which I also requested. Again, no response has ever come to date. Finally, out of frustration with both the buyer and Paypal, and both of them lacking to make any efforts whatsoever to restore my privileges and potentially threatening my outstanding transactions (five were pending payment), I emailed the full amount of the purchase (a total now of $17.00 in refunds) with the request, again, to both the buyer and Paypal to lift the restrictions. This occurred on 05/22/2006, Paypal transaction id # 30750822S1609962F, and of course, as with every transaction, whether it be a purchase or refund, Paypal has taken a percentage from the total, which I feel is unfair since they refused to even respond to my repeated requests for assistance or explanation. So as usual, they failed to even respond to my messages and failed to comply in any way. Yesterday, on 05/22/2006, I called Paypal and through much arguing, managed to get at least some of the restrictions lifted so that I may continue to receive payments from my outstanding buyers. Unfortunately, despite the fact, that the Paypal website implies that “resolution” and “limitations” can be alleviated by issuing a complete refund, it has not happened. Does this constitute false advertising? This entire event could have been avoided my the following: 1. Not leaving the items to be shipped in my car resulting in a delay (yes, I accept some responsibility for this incident). 2. Having the buyer utilize the tracking information forwarded to her and/or contacting me at any point during this nightmare to inquire about the situation. 3. Response by either the buyer or Paypal to expedite resolution of this issue. 4. Paypal to comply with the statements and policies as outlined on their website, and respond to member inquiries. Since I never did get that positive feedback that the buyer promised in writing, I fear that a negative remark will adversely affect potential buyers to choose to do business with me. Thank you for listening to and considering my complaint. I am requesting no significant financial gains from this, but ask for the following in fairness: 1. Return of the original items sold to the buyer, after which I will refund the cost paid by the buyer ($7.00, unless evidence of tampering suggests that the materials were separated from their original staple affixations and illegally Xeroxed, at which time I would request $25.00) including all Paypal charges incurred from her actions. 2. A positive feedback for future business practices. 3. An apology and reimbursement of the charges associated with this item’s multiple transactions. 4. Public record of deviation of policy and failure to answer/respond to client requests for assistance.
