Since 8-9 months, I am having a problem in the present apartment in Monterey Town House. The apartment just above mine is given to a family with 3 year old kid. They make lots of noise and are giving domestic disturbance up to 12 midnight and continue sometimes until 2am.


 


I kept on complaining about it to the present owners by word and the answer I got was – they will just stay for three months, not more than that. Now it’s been more than 9 months. No action taken.


 


We are expecting a second baby and I wanted to make the place we live a better one with no such kind of disturbances mentioned above.


 


So I approached Lewis Apartment owners during the first week of April and was told that there is going to be an apartment (#11) available soon on the same street that I live in. They asked me for $25 each for my wife and me for credit checking. Since I didn’t had any money at that time, I didn’t give.


 


On 5th April, I gave them a deposit of $875 and Erica told us that they are going to replace the door (which is warned out as pointed by me), clean out the apartment for living and we decided that we will sign the lease on 28th of April.


 


On 19th April, we called-up and told that we have plans to visit SanDiago and wanted to sing the lease on 22nd instead of 28th of April.


 


Incidentally, I visited the apartment #11 on 19th and noticed nothing major changed from 5th until. So, called-up Erica and to shocking she told – the apartment is ready to move in.


 


I pleaded them to atleast paint the door but in vain. The explanation they gave is – ‘If we paint your door then all other apartments in the complex will as for their doors too.’


 


So, on 19th April, I gave a notice to Lewis apartments that I do not want apt#11. There was a surprise waiting for me – now they told because they held the apartment for me from 5th, they are not going to give my advance deposit back. This is California Apartment Law according to them. News to me!!


 


Today is May 15th, still waiting for a word from Lewis Apartments Management.
