the boulevard company / extreme water damage from their property to mine the boulevard company is building 21 town homes at the location of Laurel avenue and randolph road. On 6/12/06 I came home around 9:00pm to find a complete flood od water coming off their property into my basement just flooding in as I watched, A friend of mine ran downstairs and used the water vac as much as possible but the water was flooding in too fast to try to control. I called the owner and demanded that they send someone over right now and they did. Do not know his name but he could not believe it. This entire block slants down hill. Lived here for 25 years. About four years ago, a developer bought and tore down all 4 houses next to me and when a heavy rain came, it flooded my basement and he paid to clean up. He then built a burm to keep the water off my property and this worked until several years later when the burm fell apart and I was flooded again. Then the boulevard company bought the empty property a year ago or so and at the time. I told the project manager that if they tore down the bum, they better have sufficient drainage to keep this water away from me. Oh yes they said. First heavy rain and guess what. Tthe project manager and the vice president of construction arrived the next morning to look at all of the water downstairs, and I have call a gentleman who has handled this for me before who owns Coit Services for restoration to come give me an estimate whill they were here and it ran around $5380 or a little more. These two men looked at the coit man and said go ahead and clean up we will take care of it. He started that morning. These men proceeded to build a dam after admitting that this was there fault to control it for now. A week later they send me a letter saying that it was my fault and call my insurance and that they would pay if I would sign an agreement stating that I would never ever in the future come back on them for further water damage. What a joke. The coit man still has not been paid. I called the City Land Use and Developement who controls this project and the next morning an inspecter came at 9:00am looked at my pictures and the dam they built and declared that most definitely it was their responsibilty and he would go back to his office and send them notice that he would cut their power and fine them daily until they paid. A week later I call him and he said that his superiors said that since the mess had been cleaned up they could do nothing. At the same time he told me to call the city attorney about this. The N.C. Statutes are very clear about a problem like this and he gave me the papers that address this. Can you help at all? Thank you, Johnson Hayes Elliott (Jon). P.S.
