Complaint Reguarding AOL Billing

Below is a letter I sent to AOL reguarding thier billing practices. We had been charged for 17 months of service when we had cancelled the account within a week of setting up the account. We cancelled 3 times and it wasnt until the last time when we had threatened leagal action that AOL customer service gave us a cancellation number.

To Whom It May Concern:

 

I signed up for AOL service in February of 2005. Per your terms of service, “Any trial promotion must be used within the specified time of the trial. You must cancel your account before the end of the trial period to avoid being charged a membership fee”. I called and cancelled the service within the first week. According to above-mentioned terms of service, when cancelling prior to the end of the free trial period, no charges will be incurred. Not only did your bill me for February 2005, but you have been billing me monthly ever since.

 

Due to health and financial issues, I have not had adequate access to my mail or a computer. Over the past 17 months, I have called and cancelled this service twice, the first time in February 2005 and the second time on July 28, 2006. My girlfriend has also called and cancelled the service in September 2005. The only time I was given a confirmation number (#0650096296) was this last time on July 28th, after threatening legal action.

 

From February 2005 through February 2006, I was charged $23.90/month, and from March 2006 through July 2006, I was charged $25.90/month, for a total of $440.20. To add insult to injury, my current statement shows that I incurred a $35 overdraft charge from my bank, due to your illegal monthly charge.

 

I expect to be fully refunded for the $440.20, and I do not expect to ever see any further charges from AOL. I am disputing your monthly charges with my bank. I am contacting the Better Business Bureau and reporting your shabby business practices. My legal counsel has advised me that it is in my best interest to take further punitive action against your business.

 

The total amount due to me from AOL is $475.20. I expect to see that amount fully refunded to me via check to name and address listed below. If you feel the need to contact me, I can also be reached at the address below.
