Bill Heard Chevrolet sales practice(s) violate public policy, is unfair, misleading, deceptive, and injurious to consumers who are left without a vehicle and lack the ability to get one because they no longer have a trade-in vehicle as a down payment, and/or, their cash down payment, and cannot secure affordable financing.

 

BHC knowingly "Spotted" my son and I feel they violated the Truth In Lending Act [Source: Section 101 of Title/of The Act of May 29, 1968 (Pub. L. No. 90-321: 82 Stat. 146) effective May 29, 1968] which involves informed use of credit. My son clearly did not understand the numbers on BHC's contract until my daughter and myself explained them to him. By BHC's deceptive sales practices they knowingly "Undermined" my sons rights.

 

Now, my son no longer has his Dodge truck (trade-in) Bill Heard Chevrolet. The bank that financed this Dodge truck is calling my son for payment. Bill Heard Chevrolet sold this Dodge, reposed the new truck, kept the $2000.00 cash down payment, and did not pay off the Dodge trade-in.

 

We were assured by Bill Heard Chevrolet's Finance Manager, Mr. Lloyd Nolan, that my son was indeed financed; however, he would not provide the name of the finance company.

 

After running my son's credit report, detailing various inquires by Bill Heard Chevrolet, and obtaining his credit score, and a subsequent letter dated 24 January, 2006 from only one finance company, explaining that they had denied credit based upon the finance terms Bill Heard Chevrolet had submitted and that they had sent an alternate proposal, it was quite apparent that my son had been scammed. I use the word "scammed" solely because we visited with Mr. Nolan 23 January, 2006 to see what could be done to get my son's truck back. It appears that BHC did not even try to obtain credit until after our visit.

 

Also, the Bill Heard Chevrolet salesman talked my son into writing a $3500.oo "Hold Check" which was to be returned when the $2000.00 cash down payment was presented to BHC. When my son made the down payment and asked for the check back, he and the salesman went to retrieve the check, they were told it could not be found, but that when it was found it would be "shredded". Instead of shredding the check, a Bill Heard Chevrolet employee wrote over my sons "Hold Check" in different colored ink/writing "Down Payment" and then BHC proceeded to try and cash the check. My son never expected this to happen; therefore, the check was spotted by his bank as "insufficient funds"; also, the bank noted the check had been altered, closed my son's account as they thought someone was trying to solicit funds illegally.

 

BHC picked up the new truck with my sons tools still in it. My son missed two days of work due to no transportation/tools. Only after my oldest son telephones BHC is my youngest son allowed to get his tools.

 

I thought my son was an isolated incident; however, my daughter is discussing what has happened with a coworker and is overheard by another coworker who says "oh my God, they did the same thing to me". This really got me to thinking; I love the Internet. I started looking at different search engines and found "Ripoffreport.com". Apparently Bill Heard Chevrolet is making this a standard all across the United States. I was appalled at the number of persons this exact same thing has happened to. There is a Class Action Suit being brought against Bill Heard Chevrolet in Florida for this exact thing.

 

I feel that Texas consumers should be made aware of this "Spotting" practice!
