I purchased a Health o Meter Ottomand and Leg Massager on Jan 31,2006. When I got home the unit was broken. I never looked in the box when I bought it and it would be my guess that it was the Massager that the store had on display for the public to try out all during the holiday season. I tried to take it back to the store and the Supervisor, Abel, said that all sales were final. He went on to tell me that the store is now in a Clearence mode (recently purchased by the Federated Corp) and that he could not do anything for me!! I told him it was fruadulent to place a broken piece of equipment in a box and sell it.. He said there was nothing he could do.

HELP! Do I have any recourse? I told him that I would take the store to small claims court and he said "fine". I can't believe that this is legal. Abel said it's posted al l over the store that there are no returns. and that is why I am just "out of luck".

Anybody out there know if I there is anything that I can do???? Would I be wasting my time in small claims court???
